Mike,

The division created by the passage of SB54 has been widely felt. Narratives were crafted, lines were drawn in the sand and teams were selected. The political fallout has been severe, perhaps more so than any other issue in the past decade. But, unlike any other issue in the past decade, SB54 arguably has the most dramatic impact on Utah’s political climate.

However, through it all you have supported Associate Rights for political parties. Either from the beginning, or through a more recent conversion, you decided that Utah’s Caucus-Convention System is a superior process to elect candidates. Or, perhaps, at a more basic level you simply believe political parties should have the final say in how they elect their party’s nominees.

Regardless of the specifics, we appreciate the resolve you have demonstrated in the face of public criticism. We understand the stakes that are play, both politically and constitutionally. It is with this understanding that we ask you to join the Utah Republican Party’s appeal to the Supreme Court; you can view the amicus memorandum here (see link). By now you may have heard that on October 9 we filed a petition for certiorari (see link) to our nation’s highest court.  We would value your support by adding your name to an amicus brief (see link) on behalf of our petition, due about November 12.

A number of high-profile organizations and individuals have already joined our effort:

  • US Senator Mike Lee (UT)
  • Multiple state political parties
  • Libertarian National Committee
  • Constitutional National Committee
  • Judicial Watch
  • The Pacific Legal Foundation
  • The CATO Institute
  • Free Speech Coalition
  • Eagle Forum

Your addition will send a clear message that this issue not only important for the legal outcomes at play, but that time has not diminished the necessity for resolution.

Please reach out to discuss the direction and impact of the case.

Sincerely,

Phill Wright and advocates of Constitutional Rights
