5    AN ACT RELATING TO PUBLIC EDUCATION; CREATING A CENTENNIAL CHARTER
6    SCHOOLS TASK FORCE; PROVIDING FOR MEMBERSHIP; PROVIDING DUTIES AND
7    FOR AN INTERIM REPORT; PROVIDING FOR A $24,500 APPROPRIATION;
8    PROVIDING AN EFFECTIVE DATE; AND PROVIDING A REPEAL DATE.
9    This act enacts uncodified material.
10    Be it enacted by the Legislature of the state of Utah:
11        Section 1. Centennial Charter Schools Task Force -- Creation -- Membership --
12     Quorum -- Staff.
13        (1) (a) There is created the Centennial Charter Schools Task Force consisting of the
14    following 15 members:
15        (i) three members of the Senate appointed by the president of the Senate, no more than two
16    of whom may be from the same political party;
17        (ii) five members of the House of Representatives appointed by the speaker of the House
18    of Representatives, no more than three of whom may be from the same political party;
19        (iii) one member shall be from the governor's office h [ appointed by the governor ] h ;
20        (iv) one member shall be from the State Office of Education;
21        (v) one member shall be a h CERTIFIED PUBLIC h school teacher;
22        (vi) one member shall be a school district administrator;
23        (vii) one member shall be a private school representative;
24        (viii) one member shall be a parent of a student; and
25        (ix) one member shall be a representative of the business community.
26        (b) The members listed in Subsections (1)(a) h [(iv) ] (iii) h through(ix) shall be appointed

27    the governor h [ , the president of the Senate, and the Speaker of the House ] h .

1        (2) (a) The president of the Senate shall designate a member of the Senate appointed under
2    Subsection (1)(a)(i) as a cochair of the task force.
3        (b) The speaker of the House of Representatives shall designate a member of the House
4    of Representatives appointed under Subsection (1)(a)(ii) as a cochair of the task force.
5        (3) (a) A majority of the members of the task force constitute a quorum.
6        (b) The action of a majority of a quorum constitutes the action of the task force.
7        (4) (a) Salaries and expenses of the legislative members of the task force shall be paid in
8    accordance with Section 36-2-2 and Legislative Joint Rule 15.03.
9        (b) Members of the task force who are not legislators receive no additional compensation
10    for their work associated with the task force.
11        (5) The Office of Legislative Research and General Counsel shall provide staff support
12    to the task force.
13        Section 2. Duties -- Interim report.
14        (1) The task force shall review and make recommendations on the following issues:
15        (a) the establishment of centennial charter schools within the state system of public
16    education, administered and staffed by public employees;
17        (b) the creation of centennial charter schools within the public education system,
18    established and operated by private providers;
19        (c) funding of the centennial charter schools through weighted pupil units so that no tuition
20    would be charged;
21        (d) the need for strong parental involvement at the schools;
22        (e) performance standards for the schools; h [ and ] h
23        (f) open enrollment policies for the schools, including the possibility of dual enrollment
24    for home schoolers h [. ] ;
24a         (g) THE CREATION OF CENTENNIAL CHARTER SCHOOLS TO PROVIDE ALTERNATIVE
24b     EDUCATION; AND
24c         (h) ANY RELATED ISSURES ASSIGNED BY THE LEGISLATIVE MANAGEMENT COMMITTEE. h
25        (2) A final report, including any proposed legislation, shall be presented to the Education
26    Interim Committee before December 31, 1997.
27        Section 3. Appropriation.
28        There is appropriated from the General Fund for fiscal year 1996-97:
29        (1) $3,500 to the Senate to pay for compensation and expenses of senators on the task
30    force;
31        (2) $6,000 to the House of Representatives to pay for compensation and expenses of

1    representatives on the task force; and
2        (3) $15,000 to the Office of Legislative Research and General Counsel to pay for staffing
3    the task force.
4        Section 4. Effective date.
5        If approved by two-thirds of all the members elected to each house, this act takes effect
6    upon approval by the governor, or the day following the constitutional time limit of Utah
7    Constitution Article VII, Section 8, without the governor's signature, or in the case of a veto, the
8    date of veto override.
9        Section 5. Repeal date.
10        This act is repealed December 31, 1997.
