5    AN ACT RELATING TO MOTOR VEHICLES; AMENDING CERTAIN VEHICLE
6    REGISTRATION FEES; DESIGNATING DISTRIBUTION OF CERTAIN REGISTRATION
7    FEES; h [ AND ] h PROVIDING AN EFFECTIVE DATE h ; AND PROVIDING A REPEALER AND
7a     COORDINATION CLAUSE h .
8    This act affects sections of Utah Code Annotated 1953 as follows:
9    AMENDS:
10         41-1a-1201, as last amended by Chapter 173, Laws of Utah 1996
11         41-1a-1206, as last amended by Chapter 184, Laws of Utah 1994
12         63-49-22, as enacted by Chapter 279, Laws of Utah 1996
13    Be it enacted by the Legislature of the state of Utah:
14        Section 1. Section 41-1a-1201 is amended to read:
15         41-1a-1201. Disposition of fees.
16        (1) All fees received and collected under this part shall be transmitted daily to the state
17    treasurer.
18        (2) Except as provided in Subsections (3) [and], (4), and (6), and Subsection 41-1a-408(8),
19    all fees collected under this part shall be deposited in the Transportation Fund.
20        (3) (a) Funds generated under Subsections 41-1a-1211(1)(a), (8)(a), and (9) and Section
21    41-1a-1212 may be used by the commission as a dedicated credit to cover the costs incurred in
22    issuing license plates under Part 4, License Plates and Registration Indicia.
23        (b) Funds collected under Subsections 41-1a-1211(3), (5)(b), and (5)(c), less the actual
24    cost incurred by the division in purchasing decals for special group license plates, shall be
25    deposited in the Transportation Fund.
26        (c) Fees for statehood centennial special group license plates shall be collected and
27    deposited:

1        (i) through December 31, 1996, as provided in Title 9, Chapter 1, Part 5, Utah Statehood
2    Centennial Commission; and
3        (ii) beginning January 1, 1997, in the Transportation Fund, less production and
4    administrative costs incurred by the commission.
5        (d) Fees for Olympic special group license plates shall be collected and deposited as
6    provided under Section 41-1a-417.
7        (4) All funds available to the commission for purchase and distribution of license plates
8    and decals are nonlapsing.
9        (5) Except as provided in Subsection (3) and Section 41-1a-1205, the expenses of the
10    commission in enforcing and administering this part shall be provided for by legislative
11    appropriation from the revenues of the Transportation Fund.
12        (6) The following portions of the registration fees imposed under Section 41-1a-1206 for
13    each vehicle shall be deposited in the Centennial Highway Trust Fund created under Section
14    63-49-22:
15        (a) $10 of the registration fees imposed under Subsections 41-1a-1206 (1)(a), (1)(b), (2),
16    and (5);
17        (b) $1 of the registration fees imposed under Subsections 41-1a-1206 (1)(c)(i), (1)(c)(ii),
18    and (1)(d)(ii);
19        (c) $2 of the registration fee imposed under Subsection 41-1a-1206 (1)(e)(ii);
20        (d) $3 of the registration fee imposed under Subsection 41-1a-1206 (1)(d)(i); and
21        (e) $4.50 of the registration fee imposed under Subsection 41-1a-1206 (1)(e)(i).
22        Section 2. Section 41-1a-1206 is amended to read:
23         41-1a-1206. Registration fees -- Fees by gross laden weight.
24        (1) Except as provided in Subsection (2), at the time application is made for registration
25    or renewal of registration of a vehicle or combination of vehicles under this chapter, a registration
26    fee shall be paid to the division as follows:
27        (a) [$12.50] $22.50 for each motorcycle;
28        (b) [$11] $21 for each motor vehicle of 12,000 pounds or less gross laden weight,
29    excluding motorcycles;
30        (c) unless the semitrailer or trailer is exempt from registration under Section 41-1a-202
31    or is registered under Section 41-1a-301:

1        (i) [$10] $11 for each trailer or semitrailer over 750 pounds gross unladen weight; or
2        (ii) [$7.50] $8.50 for each commercial trailer or commercial semitrailer of 750 pounds or
3    less gross unladen weight;
4        (d) (i) [$30] $33 for each farm truck over 12,000 pounds, but not exceeding 14,000 pounds
5    gross laden weight; plus
6        (ii) [$8] $9 for each 2,000 pounds over 14,000 pounds gross laden weight; and
7        (e) (i) [$45] $49.50 for each motor vehicle or combination of motor vehicles, excluding
8    farm trucks, over 12,000 pounds, but not exceeding 14,000 pounds gross laden weight; plus
9        (ii) [$16.50] $18.50 for each 2,000 pounds over 14,000 pounds gross laden weight.
10        (2) The initial registration fee for a vintage vehicle is [$10] $20.
11        (3) If a motor vehicle is operated in combination with a semitrailer or trailer, each motor
12    vehicle shall register for the total gross laden weight of all units of the combination if the total
13    gross laden weight of the combination exceeds 12,000 pounds.
14        (4) (a) Registration fee categories under this section are based on the gross laden weight
15    declared in the licensee's application for registration.
16        (b) Gross laden weight shall be computed in units of 2,000 pounds. A fractional part of
17    2,000 pounds is a full unit.
18        (5) The owner of a commercial trailer or commercial semitrailer may, as an alternative to
19    registering under Subsection (1)(c), apply for and obtain a special registration and license plate for
20    a fee of [$100] $110.
21        (6) Except as provided in Section 41-6-163.6, a truck may not be registered as a farm truck
22    unless:
23        (a) the truck meets the definition of a farm truck under Section 41-1a-102; and
24        (b) (i) the truck has a gross vehicle weight rating of more than 12,000 pounds; or
25        (ii) the truck has a gross vehicle weight rating of 12,000 pounds or less and the owner
26    submits to the division a certificate of emissions inspection or a waiver in compliance with Section
27    41-6-163.6.
28        (7) A violation of Subsection (6) is a class B misdemeanor that shall be punished by a fine
29    of not less than $200.
30        Section 3. Section 63-49-22 is amended to read:
31         63-49-22. Centennial Highway Trust Fund.

1        (1) There is created an expendable trust fund entitled the Centennial Highway Trust Fund.
2        (2) The fund consists of monies generated from the following revenue sources:
3        (a) any voluntary contributions received for the construction, major reconstruction, or
4    major renovation of state or federal highways; [and]
5        (b) appropriations made to the fund by the Legislature; and
6        (c) registration fees designated under Subsection 41-1a-1201(6).
7        (3) (a) The fund shall earn interest.
8        (b) All interest earned on fund monies shall be deposited into the fund.
9        (4) The executive director may use fund monies, as prioritized by the Transportation
10    Commission, only to pay the costs of construction, major reconstruction, or major renovation to
11    state and federal highways.
12        Section 4. Effective date.
13        This act takes effect on July 1, 1997.
13a          h Section 5. Repealer and coordination clause.
13b         THE AMENDMENTS MADE IN SUBSTITUTE H.B. 414 CONTINUE THROUGH JUNE 30, 2007, ON
13c     WHICH DATE THESE CHANGES ARE REPEALED.
13d         THE OFFICE OF LEGISLATIVE RESEARCH AND GENERAL COUNSEL IS DIRECTED, IN
13e     PREPARING THE CODE DATABASE FOR PUBLICATION, TO RESTORE SECTION 41-1a-1201, AS
13f     AMENDED BY SB 204, 1997 ANNUAL GENERAL SESSION, AND SECTION 41-1a-1206, AS THESE
13g     SECTIONS EXISTED PRIOR TO THE AMENDMENTS IN SUBSTITUTE H.B. 414. THE AMENDMENTS
13h     SHALL BE GIVEN AN EFFECTIVE DATE OF JULY 1, 2007. h
