APPROPRIATION FOR COUNTY LAND USE PLANNING

    AN ACT RELATING TO COUNTIES; APPROPRIATING $150,000 TO THE OFFICE OF
    PLANNING AND BUDGET TO DISTRIBUTE TO SOUTHERN UTAH UNIVERSITY
    TO CONDUCT WORKSHOPS ON COUNTY LAND PLANNING AND TO COUNTIES
    AS MATCHING FUNDS FOR TRAINING IN PLANNING.
    This act enacts uncodified material.
    Be it enacted by the Legislature of the state of Utah:
        Section 1. Intent.
        The Legislature finds that the value of property throughout the state is enhanced by
    appropriate land-use planning by the counties, that revenues to the state depend to a significant
    extent on the value of the property generating those revenues, and that the quality of land-use
    planning improves with training and education. It is the intent of the Legislature in appropriating
    these funds to help meet the statewide need for training and education of county officials involved
    in county land planning activities to improve the quality of land-use planning by the counties.
        Section 2. Appropriation.
        (1) (a) There is appropriated from the General Fund for fiscal year 1997-98, $150,000 to
    the Office of Planning and Budget.
        (b) The Office of Planning and Budget:
        (i) shall distribute up to $10,000 of the appropriated funds to Southern Utah University
    for use by its Utah Center for Rural Life to conduct workshops on preparation of county land
    plans, including protection of private property rights and other rights attached to property;
        (ii) shall determine, in conjunction with the Utah Association of Counties, the counties
    most qualified to receive the remainder of the appropriated funds to assist in developing and
    implementing county land plans, based on criteria established by the Office of Planning and
    Budget;
        (iii) may consider the recommendation of the Governor's Local Government


    Comprehensive Planning Project Steering Committee in establishing those criteria; and
        (iv) shall distribute the remaining funds to counties that:
        (A) meet the criteria established by the Office of Planning and Budget;
        (B) match the amount distributed by the Office of Planning and Budget in funds or in kind;
        (C) agree to encourage county officials and county attorneys to attend the workshops; and
        (D) agree to review and, if necessary, revise the comprehensive general plan at least
    annually.
        (c) In planning and presenting the workshops provided under Subsection (1)(b)(i), Southern
    Utah University, through its Utah Center for Rural Life, may involve county officials who are
    preparing or have completed a county land plan.
        (2) These appropriations are nonlapsing.
