A JOINT RESOLUTION OF THE LEGISLATURE DIRECTING THE LEGISLATIVE
MANAGEMENT COMMITTEE TO ASSIGN TO THE APPROPRIATE INTERIM
COMMITTEE ITEMS OF STUDY; AND REQUESTING A REPORT TO THE 52ND
LEGISLATURE IN THE 1998 ANNUAL GENERAL SESSION.
Be it resolved by the Legislature of the state of Utah:
WHEREAS the Legislative Management Committee is created by law as a permanent
committee to receive and assign matters for the interim study of the Legislature; and
WHEREAS the 52nd Legislature has determined that certain legislative issues require
additional investigation and study:
NOW, THEREFORE, BE IT RESOLVED that the Legislative Management Committee
assign to the appropriate interim committee the duty to study and make recommendations for
legislative action they consider necessary to the 52nd Legislature in the 1998 General Session, or
earlier if indicated, from, but not limited to, the following items of study.
BE IT FURTHER RESOLVED that the Legislative Management Committee, in making
study assignments from this list and in approving study requests for individual committees, give
due regard to the available time of legislators and the budget and capacity of staff to respond
adequately to the number and complexity of the assignments given.
1. Adequacy of Capital Improvements - to study the adequacy of the capital improvement
(AR & I) formula as currently in Section 63A-5-103(8).
2. Adult High School Completion - to study whether to modify the basis on which school
districts receive their pro rata share of the Adult High School appropriation. (SB 158)
3. Appropriation for Tooele School District Schools - to study whether an appropriation
should be made to expand the technological capabilities of Tooele School District schools. (HB
375; intent language, HB 405)
4. Appropriations Intent Language - to study higher education appropriations intent
language (faculty work load, FTE counts, enrollment).
5. Budget Task Force - to study the creation of a task force that would conduct an in-depth
analysis of a different state agency budget each year. (SB 22)
6. Categorical Funding of Education Dollars - to study and review the increase in
categorical funds in the education budget.
7. Construction and Maintenance of UDOT Buildings - to study UDOT and DFCM
relationships in construction and maintenance of UDOT buildings.
8. Fiscal Prioritization - to study legislative rules on access to the fiscal prioritization
process. (SJR 8)
9. Funding Capital Improvements - to study increasing the formula for set aside funds for
capital improvements.
10. Governor's Budget Requirements - to study whether to require the Governor to include
in the budget for the Department of Human Services cost-of-living increases for private providers
with the Division of Child and Family Services and the Division of Youth corrections. (HB 388)
11. Impact of Bills on Local Government - to study whether to add a note to all legislative
bills stating their impact on local government.
12. Schools for the Deaf and Blind Funding - to study whether to fund schools for the deaf
and blind on a WPU basis rather than the line item, and whether to add an enhanced WPU for single
and multiple disabilities.
13. Use of Arts Funding - to study the allocation of state funds for the arts to verify the
appropriateness of the receiving entity.
14. Wildlife Resources Fee Schedule - to study and review the fee schedule for the Division
of Wildlife Resources.
15. Application to Noncommercial Projects - to study whether to create qualification
requirements for plans examiners and building officials and whether they should apply to
noncommercial projects. (Sub SB 135)
16. Beer Industry Fair Dealing Act - to study the feasibility of enacting a Beer Industry Fair
Dealing Act. (1st Sub SB 157)
17. Beer Licensees - to study the relationship between licensed beer retailers, beer
wholesalers, and retail licensees in a three-tier system. (SB 160)
18. Conservation and Housing Trust Fund - to study issues relating to the establishment of
a Utah Conservation and Housing Trust Fund.
19. Debt Collection - to study issues related to the Office of State Debt Collection.
20. Demand Drafts for Banks - to study methods to allow bank account holders to stop
payment on charges to their accounts by telemarketers. (SB 163)
21. Dishonored Checks - to study procedures dealing with checks, including processes of
banks, merchants, etc.
22. Earnest Money Requirements - to study real estate laws requiring earnest money to be
deposited in three "business" days as opposed to three calendar days.
23. Education of Insurance Professionals - to study continuing education requirements for
health insurance professionals. (HB 97)
24. Eviction Laws - to study the procedure and time needed to evict tenants.
25. High Risk Insurance Pool Funding - to study the feasibility of covered lives
assessments, especially those modeled on the New York State Health Care Reform Act of 1996.
26. Insurance Bond Pool for Mining Reclamation Costs - to study the creation of a state
insurance or bond pool, to be administered by the state risk manager, to provide a surety bond or
insurance pool for mining companies to cover mining reclamation costs.
27. Insurance Underwriting Practices - to study ways of prohibiting discriminatory
underwriting practices of insurance companies.
28. Land Survey - to study the state's land survey statutes.
29. Licensing of Engineers and Land Surveyors - to study amendments to professional
engineers and land surveyors licensing statutes. (SB 169)
30. Limited Liability - to study the possible adoption of a Uniform Limited Liability
Company Act and related issues.
31. Master Deeds of Trust - to study issues related to master deeds of trust.
32. Mental Health Insurance Regulation - to study whether to require the Commissioner of
Insurance to issue rules regarding mental health insurance. (HB 193)
33. Nonlicensed Geologists - to study whether to permit a geologist to practice his
profession without violating licensing laws and without having to establish geology as a licensed
profession under the Department of Commerce. (1st Sub SB 169)
34. Olympic Repayment - to study whether the scheduled dates of repayment by the Salt
Lake Organizing Committee for the purchase of the Winter Sports Park should be modified.
35. Privatization of Workers' Compensation Fund - to study whether the fund should be
allowed to privatize and what the state would do to replace it as the provider of last resort.
36. Professional Licensure Restrictions - to study whether to require licensed professionals,
who have been issued restricted or probationary licenses, to disclose the restrictions or conditions
of their license to clients, patients, customers, consumers, etc.
37. Real Property Improvement Agreements - to study real property improvement
agreements including the perspectives of contractors, subcontractors, owners, and insurers. (HB 19)
38. Regulation of Auto Repair Dealers - to study moving the regulation of automobile repair
dealers from the State Tax Commission to the Department of Commerce. (SB 176)
39. Uniform and Limited Liability Partnership - to study the Revised Uniform Partnership
and Limited Liability Partnership Act. (SB 183)
40. Wine Sampling - to study a cork finished wine sampling pilot program. (HB 354)
41. Workers' Compensation - to study workers' compensation for agriculture employees.
42. Workers' Compensation Fund Contracts - to study whether to permit the Workers'
Compensation Fund of Utah to enter into exclusive contracts with Utah health care providers.
43. Academic Improvement Trust Fund - to study establishment of the Utah Academic Trust
Fund for community colleges.
44. Accelerated Learning - to study and review concepts and options which will enhance
accelerated learning. (HB 35)
45. Area Technology Centers and Service Regions - to study and review the funding and
governance of ATC and technology service regions.
46. Career Ladders - to study and review the status of the career ladder program in public
education with the objective of endorsing the status quo or recommending innovations that will
enhance its original purpose.
47. Centennial Charter Schools - to study and review the concept of charter schools to
determine if the concept has a useful purpose in the reforms that have been instituted.
48. Compulsory Education - to study issues related to compulsory education.
49. Diversified Tuition Costs - to study the feasibility of charging less for tuition leading
to non-four year degrees, which are based on more technical/vocational curriculum.
50. Duties of State Superintendent and Local School Boards - to study whether to amend
the Utah State Constitution to make the state superintendent an elective office and to modify the
powers of the local school boards. (HJR 18)
51. Education Strategic Plan - to study and revisit the state education strategic plan.
52. Education Tax Credit - to study an income tax credit for educational choice. (HB 102)
53. Educational Achievement Testing in Public Schools - to study whether the tests are
reflecting achievement and what tests are most valid.
54. Educational Neglect - to study issues related to educational neglect.
55. Emergency Injections - to study the administering of emergency injections of
anaphylactic shock at schools. (HB 130)
56. Extracurricular Activities - to study the possibility of developing a uniform measuring
system that will provide data that can be used to compare the actual time out of class among
individual school districts due to extracurricular activities.
57. Faculty Workload - to study the faculty workload in higher education.
58. Funding of Public Safety at State Owned Colleges and Universities - to study public
safety funding at state owned colleges and universities, which are currently subject to budget cuts
from higher education.
59. Higher Education Master Plan - to study the development of a master plan for higher
education.
60. Impact of Extracurricular Activities - to study the impact of extracurricular activities
on schools, particularly in rural areas.
61. Improved Teaching - to study ways to improve the quality of teaching in Utah.
62. Inservice Mentoring - to study and review the possibility of duplicating successful
teaching applications for instruction and discipline through inservice programs.
63. JAG Program - to study issues related to the JAG Program.
64. Postsecondary Comprehensive Guidance - to study and review the need for a
comprehensive guidance and counseling program in the colleges and universities with the objective
of reducing the time typically required to graduate from a postsecondary institution.
65. School Curriculums - to study school curriculum issues.
66. School Library Media Personnel Needs - to study the need for certified library media
teachers and the process to deal with the lack of appropriate personnel in school library media
centers.
67. School Truancy - to study issues related to school truancy.
68. School Uniforms - to study school uniform issues.
69. Student Parking at Public Schools - to study how parking policies can be enforced and
what policies are needed.
70. Student Safety - to study how to keep children safe from assault by other students to and
from school.
71. Teacher Preparation - to study teacher preparation ideas that can be incorporated into
teacher preparation programs at the institutions of higher education and will reflect the needs and
expectations of teachers in a modern classroom.
72. Technology Review - to study and receive an update on the viability of technology in
the public school classroom and instruction and training via the Western Governor's University
(Virtual University), and describe the role educational institutions play in the state's electronic
highway.
73. Adjudication of Oil and Gas Royalties - to study oil and gas royalty owners'
adjudication options. (HB 120)
74. Eco-Terrorism - to study penalties for acts that impede timber, agricultural, or mining
industries.
75. Endangered Species Mitigation Fund - to study the establishment of Endangered Species
Mitigation Fund. (HB 359)
76. Hunting and Fishing Fees - to study and review the fee schedule and licenses for the
handicapped and veterans.
77. Outfitters and Guides - to study the regulation of guides and outfitters.
78. School Grounds as Open Space - to study the classification of school grounds as public
open space.
79. Telecommunications Deregulation - to study issues related to telecommunications
deregulation.
80. Utility Deregulation - to study issues related to the deregulation of electric utilities. (HB

81. Wildlife Board Nomination - to study the creation of a nominating board for the
nomination of members to the Wildlife Board.
82. Wildlife Management Planning - to study and identify appropriate planning processes
and means of involving the public when wildlife is transplanted, reintroduced, or introduced, or
when the Division of Wildlife Resources acquires land or makes changes in the use of its land.
83. Wildlife Opportunities - to study ways to provide more wildlife opportunities for
citizens which do not endanger wildlife.
84. Coordination of Tobacco Programs - to study the coordination of tobacco education,
prevention, cessation, and control programs in Utah.
85. Disclosure Requirements - to study whether to require disclosure on health maintenance
organizations offering Medicare coverage consistent with federal law. (SB 226)
86. Hazardous Waste Transport - to study and review state regulation of the transportation
of nuclear and other hazardous waste.
87. Health Benefits - to study the parity of mental health benefits with other health care
coverage, including alcohol and drug (substance abuse) coverage.
88. HIV Testing Procedures - to study how to reconcile conflicts between the Health Code
and the Judicial Code regarding HIV testing procedures following the significant exposure of an
emergency medical services provider or public safety officer. (HB 302)
89. Nurse Practice Act - to study the revision and updating of the Nurse Practice Act.
90. Penalties for Sale of Tobacco to Youth - to study the enhancement of civil penalties for
licensees and employees of licensees who sell tobacco to persons under the age of 19; and to study
joint enforcement authority between local law enforcement and local health departments regarding
tobacco sales to underage persons.
91. Poison Control Needs - to study cost of living increase needs for poison control.
92. Science Advisory Council - to study the role and reporting structure of the Utah State
Science Advisory Council.
93. Water Quality Act Penalties - to study criminal penalties for violations of Utah Water
Quality Act.
94. Age Requirements in Offenses Against Children - to study whether to change the age
requirements for statutory rape and sexual offenses against children, as well as other crimes against
children.
95. Benefits for Grandparents - to study benefits for grandparents raising grandchildren.
96. Children and Divorce - to study children's rights in a divorce.
97. County Option Affordable Housing Trust Fund Act - to study ways to create and fund
county housing trust funds.
98. Early Intervention - to study the feasibility of a sliding scale fee for early intervention.
99. Office of Recovery Services and Noncustodial Parents - to study the administrative
power of the Office of Recovery Services and its possible punitive and negative effect on
noncustodial parents who are making an effort to pay child support.
100. Quality Child Care - to study what can be done to encourage greater availability of
quality child care.
101. Victims of Statutory Rape - to study the age limit of victims of statutory rape. (HB
256)
102. Alternative Dispute Resolution - to study the use of alternative dispute resolution for
modification of child support and other issues of divorce after the original decree of divorce.
103. Civil Forfeiture - to study civil forfeiture statutes.
104. Civil Relief Act - to study whether Utah should adopt a state version of the federal
Soldier's and Sailor's Civil Relief Act. (HB 105)
105. Community Arbitration Program - to study a juvenile offender community arbitration
program.
106. Criminal Nonsupport - to study criminal nonsupport amendments. (HB 299)
107. Curfews - to study whether the state can, should, or needs a statewide curfew for
juveniles that would only apply to areas where there is currently no curfew in place. (SB 42)
108. Designation of Forfeiture Proceeds for Prevention Programs - to study the designation
of a portion of asset forfeiture proceeds for prevention programs.
109. Divorce Laws - to study divorce laws, specifically no-fault divorce.
110. Domestic Relation Laws - to study the state's domestic relation laws.
111. Immunity for Volunteers - to study the granting of immunity to those who volunteer

112. Juvenile Crime Recommendations - to study and respond to juvenile crime
recommendations.
113. Lawsuits by Prisoners - to study restrictions on lawsuits by prisoners.
114. Limited Parental Liability - to study whether to limit the liability of parents who
choose spiritual treatment in lieu of medical treatment for their children.
115. Plea Bargaining - to study plea bargaining in the courts.
116. Prison Construction Costs - to study ways to save on prison construction costs.
117. Prison Housing - to study less expensive ways to house prisoners, including camps.
118. Protective Orders - to study what other states do to protect family members and
balance the rights of both sides.
119. Punishment of Sexual Predators - to study sexual predator punishment, restitution,
rehabilitation and education.
120. Statute of Repose - to study the statute of repose problem existing in Section
78-12-25.5. (HB 227)
121. Time Extensions in Protective Orders - to study whether to extend the maximum
period of time for civil provisions included in orders for protection.
122. Firefighter Death Benefits - to study public safety firefighter death benefits. (HB 123)
123. Public Safety Cost of Living Adjustment - to study whether to increase the
cost-of-living allowance for members of the public safety retirement systems. (SB 108)
124. Airplane Property Tax - to study whether to replace the airplane property tax with a
fuel tax.
125. Alcoholic Beverage User Tax Increase - to study and examine the levels of taxation
on alcoholic beverages and to make recommendations for tax increases and distribution of new
revenues for the prevention and treatment of alcohol problems and the enforcement of
alcohol-related laws.
126. Cost/Benefit Analysis of Income Tax Credits - to study the costs and benefits of
income tax credits and standards for repeal.
127. County Tax - to study the county imposition of a tourism, recreation, cultural, and
convention facilities tax.
128. Gross Receipts Tax - to study the tax equity of a gross receipts tax for electric
generating entities.
129. Income Tax Brackets - to study the need to rebracket the state income tax including
the indexing of the bracket using the consumer price index.
130. Income Tax Credits - to study corporate and individual income tax credits to increase

131. Property Tax Exemption Fee - to study issues related to the property tax exemption

132. Property Tax Relief - to study the need for property tax relief and deferral for elderly
homeowners and renters.

of the Utah State Constitution so that "fair market value" for determining the amount of property
taxes to collect be changed to a value based on the square footage of the useable or livable space on

154. Election Ballots - to study one-party voting (not by individual) and majority preference
voting.
155. Election Law Commission - to study the establishment of an election law commission.

157. Government Coordination - to study regional coordination among governmental

159. Information Technology Freeport - to study the issue of making Utah an "information
technology freeport."
160. Jail Reimbursement and Contracting - to study the coordination between the state and
counties regarding jail reimbursement and jail contracting.
161. Legislator Ethics - to study gifts to legislators, specifically dollar limits on gifts; and
issues of disclosure and exceptions.
162. Length of Office Terms - to study terms of office (2 year vs. 4 year) for certain boards
and commissions.
163. Municipal Withdrawal from Water Districts - to study whether to allow a municipality
to withdraw from a county improvement district for water services. (HB 357, 1st Sub HB 357)
164. Public Notice of Administrative Rules - to study the public notice of administrative
rules as received by the private sector, and the impact of that notice.
165. State Building Energy Savings - to study how to build energy efficiencies into public
buildings.
166. Tax Increase Voting Requirements - to study whether to amend the Utah State
Constitution to require a supermajority vote to increase taxes. (HJR 2)
167. Townships - to study issues related to incorporation procedures, annexation
procedures, and provisions related to townships. (HB 363)
168. Unincorporated Nonprofit Association - to study whether to make this Uniform State
Law part of Utah's code.
169. Voting Rights of Felons - to study the withholding of voting rights from convicted
felons.
170. Whistleblowers - to study issues related to whistleblowers in a nongovernmental entity.
171. Access Management - to study transportation access management.
172. Airport Improvement Program - to study and review the statewide airport improvement
program along with its funding source, the aviation fuel tax, to determine their adequacy.
173. Aviation Funding - to study state aviation needs and funding.
174. B and C Road Bid Limit Definition - to study whether to modify the bid limit
definition for Class B and C roads. (SB 106)
175. Combining Public Safety Services - to study the creation of a task force to study
combined public safety services in Salt Lake County.
176. Concealed Firearms - to study requirements for concealed firearms permit. (HB 118)
177. Decrease in Crime Rate - to study what the state of New York has done to dramatically
decrease its crime rate.
178. DUI Convictions - to study license plates for those convicted of drunk driving and any
possible changes in judicial/trial procedures to make it easier to convict drunk drivers.
179. DUI Laws - to study Utah's laws regarding driving under the influence of alcohol
and/or other drugs including, but not limited to: implied consent provisions, creation of a DUI
ticketable offense, lowering of the legal blood alcohol content (BAC), jail for first time offenders,
and length of driver license suspension for offenders. (HB 65, Sub HB 65)
180. Highway Code Recodification - to study state laws related to highways and the
Department of Transportation.
181. Highway Impacts on Neighborhoods - to study ways for state highway management
to be responsive to impacts on neighborhoods.
182. Highway Patrol Computers - to study issues related to highway patrol computers.
183. Highway Patrol Staffing - to study the need for additional highway patrol troopers.
184. I-15 Construction Oversight - to study legislative oversight of I-15 construction and
the centennial highway program and funding.
185. Impersonating a Peace Officer - to study the possibility of making it a crime to
impersonate a peace officer, to carry paraphernalia that imitates peace officers, or to alter the
appearance of a vehicle so that it appears to be an official vehicle.
186. Impounding Vehicles - to study issues related to the impounding of uninsured vehicles.

187. Officers' Rights - to study the procedural rights of law enforcement officers.
188. Ongoing Highway Funding - to study the funding of I-15 and other highway projects
on an ongoing basis.
189. Probation Extension - to study extending the probationary period for deputy sheriffs.
190. Protection of Highway Patrol Officers - to study ways to enhance protection of
highway patrol officers in performance of their duties.
191. Railroad Rights of Way - to study legal remedies for the abandonment of railroad
rights of way.
192. Red Light Camera - to study the use of a red light camera for traffic control.
193. Registration of Small Utility Trailers - to study registration and/or safety inspection
for small utility trailers that are now exempt but which contribute to wear and tear on roads and can
create hazards due to poor construction or needed repairs.
194. Safety Inspection Fees - to study whether to increase vehicle safety inspection fees.
195. Safety Projects - to study transportation safety project needs and funding.
196. Selling of Rights of Way - to study the feasibility of having the state purchase excess
rights of way and resell them at higher value after road construction is complete in order to boost
funding capabilities, and the feasibility of placing restrictive covenants on the use of the property
in case the property may be needed in the future for expansion.
197. Speed Limits - to study speed limits for large trucks.
198. Speeding in Construction Zones - to study whether to implement increased fines for
speeding in construction zones.
199. Toll Roads - to study the privatization of toll roads.
200. UDOT and Local Governments - to study UDOT's relationship with local government,
such as local flexibility, jurisdictional transfers, etc.
201. UDOT Bicycle Plan - to study issues related to the development of a UDOT bicycle
plan.
