11    AN ACT RELATING TO EDUCATION; PROVIDING THAT THE STATE BOARD OF
12    EDUCATION AND THE STATE BOARD OF REGENTS ARE RESPONSIBLE FOR THE
13    EDUCATION OF PERSONS IN THE CUSTODY OF THE DEPARTMENT OF
14    CORRECTIONS; AND PROVIDING A REPEALER OF A SUNSET DATE.
15    This act affects sections of Utah Code Annotated 1953 as follows:
16    AMENDS:
17         53A-1-403.5, as last amended by Chapter 13, Laws of Utah 1994
18    This act affects uncodified material as follows:
19    REPEALS:
20     Uncodified Section 3, Chapter 90, Laws of Utah 1992
21    Be it enacted by the Legislature of the state of Utah:
22        Section 1. Section 53A-1-403.5 is amended to read:
23         53A-1-403.5. Education of persons in custody of Department of Corrections --
24     Contracting for services -- Recidivism reduction plan -- Collaboration among state agencies
25     -- Annual report.
26        (1) The State Board of Education and the State Board of Regents, subject to legislative
27    appropriation, [is] are responsible for the education of persons in the custody of the Department
28    of Corrections.


1        (2) In order to fulfill this responsibility, the [board] boards shall, where feasible, contract
2    with appropriate private or public agencies to provide educational and related administrative
3    services.
4        (3) (a) As its corrections education program, the [board] boards shall develop and
5    implement a recidivism reduction plan, including the following components:
6        (i) inmate assessment;
7        (ii) cognitive problem-solving skills;
8        (iii) basic literacy skills;
9        (iv) career skills;
10        (v) job placement;
11        (vi) postrelease tracking and support;
12        (vii) research and evaluation;
13        (viii) family involvement and support; and
14        (ix) multiagency collaboration.
15        (b) The plan shall be developed and implemented through the State Office of Education
16    and the Board of Regents office in collaboration with the following entities:
17        (i) local boards of education;
18        (ii) Department of Corrections;
19        (iii) Department of Employment Security;
20        (iv) Department of Human Services;
21        (v) Board of Pardons and Parole;
22        (vi) State Office of Rehabilitation; and
23        [(vii) State Board of Regents; and]
24        [(viii)] (vii) the governor's office.
25        (c) The Legislature may provide appropriations for implementation of the plan through
26    a line item appropriation to any one or a combination of the entities listed in Subsection (b).
27        (4) The [board] boards shall make annual reports to the Legislature through the Education
28    Interim Committee on the effectiveness of the recidivism reduction plan.
29        Section 2. Repealer.
30        This act repeals:
31         Uncodified Section 3, Chapter 90, Laws of Utah 1992, Sunset date.
