5    AN ACT RELATING TO CRIMINAL CODE; MODIFYING DISCLOSURE REQUIREMENTS
6    FOR PUBLIC ASSISTANCE FRAUD.
7    This act affects sections of Utah Code Annotated 1953 as follows:
8    AMENDS:
9         76-8-1203, as enacted by Chapter 122, Laws of Utah 1994
10    Be it enacted by the Legislature of the state of Utah:
11        Section 1. Section 76-8-1203 is amended to read:
12         76-8-1203. Disclosure required -- Penalty.
13        (1) Each person who applies for public assistance shall disclose to the Department of
14    Human Services each fact that may materially affect the determination of his eligibility to receive
15    public assistance, including his current:
16        (a) marital status;
17        (b) household composition;
18        (c) employment;
19        (d) income;
20        (e) receipt of monetary and in-kind gifts; and
21        (f) other resources.
22        (2) Any person applying for public assistance who intentionally, knowingly, or recklessly
23    fails to disclose any material fact required to be disclosed under Subsection (1) is guilty of a class
24    B misdemeanor.
25        (3) Any recipient who intentionally, knowingly, or recklessly fails to disclose to the
26    Department of Human Services any change in a material fact required to be disclosed under
27    Subsection (1), within ten days after the date of the change, is guilty of a class B misdemeanor [if


1    that failure to disclose results in an overpayment].
