6    A CONCURRENT RESOLUTION OF THE LEGISLATURE AND THE GOVERNOR
7    ENDORSING THE FINDINGS OF THE COMMITTEE CHARGED WITH SEEKING AN
8    ACCEPTABLE LOCATION FOR A MUNICIPAL LANDFILL IN NORTHERN UTAH;
9    RECOMMENDING THAT POLICY BE DEVELOPED TO PROTECT THE AFFECTED
10    COMMUNITIES AND THE LANDFILL OPERATOR BY LIMITING THE NUMBER OF
11    LANDFILL SITES THAT MAY BE DEVELOPED UNDER DEPARTMENT OF
12    ENVIRONMENTAL QUALITY PERMITS FOR LANDFILL SITES THAT ARE SUBJECT
13    TO COMMITTEE REVIEW; AND STATING LEGISLATIVE INTENT.
14    Be it resolved by the Legislature of the state of Utah, the Governor concurring therein:
15        WHEREAS a permit was issued to what is referred to as the White's Valley landfill site
16    in Box Elder County;
17        WHEREAS the permit was subject to dispute regarding potential impact on local water
18    resources;
19        WHEREAS in Section 19-6-102.6 the Legislature created a landfill siting committee to
20    resolve intergovernmental disputes over landfill siting issues;
21        WHEREAS such a committee representing interests of Davis, Morgan, and Box Elder
22    Counties convened to resolve a noncommercial municipal solid waste landfill site dispute
23    involving the White's Valley site;
24        WHEREAS the committee evaluated numerous sites with the cooperation of the
25    Department of Environmental Quality;
26        WHEREAS the committee conducted numerous hearings to receive public comment; and
27        WHEREAS the committee approved three specific alternative landfill sites in Box Elder


1    County, at least one of which would be acceptable in resolving the dispute:
2        NOW, THEREFORE, BE IT RESOLVED that the Legislature of the state of Utah, the
3    Governor concurring therein, endorse the landfill siting committee's recommendations regarding
4    the siting of a landfill in Box Elder County to resolve this dispute.
5        BE IT FURTHER RESOLVED that the Legislature and the Governor recommend that
6    policy be developed by the Department of Environmental Quality to provide that, after a landfill
7    siting committee commences its efforts to resolve a landfill siting dispute, a new permit not be
8    issued unless the site has been recommended by the committee and that any new permit issued for
9    an alternative landfill site replace the disputed permit, once all necessary permits and approvals
10    for the alternative site have been finalized and the permit issued, the intent being that the landfill
11    operator not be deprived of a site, that the affected communities not be burdened by more than one
12    additional landfill site as a result of resolution of the dispute, and that development restrictions and
13    requirements placed upon the landfill operator not be more burdensome at the alternative site.
14        BE IT FURTHER RESOLVED that copies of this resolution be sent to the landfill siting
15    committee formed pursuant to Section 19-6-102.6, the Box Elder and Davis County Commissions,
16    and the Department of Environmental Quality.
