5 A JOINT RESOLUTION OF THE LEGISLATURE DIRECTING THE LEGISLATIVE
6 MANAGEMENT COMMITTEE TO ASSIGN TO THE APPROPRIATE INTERIM
7 COMMITTEE ITEMS OF STUDY; AND REQUESTING A REPORT TO THE 52ND
8 LEGISLATURE IN THE 1998 ANNUAL GENERAL SESSION.
9 Be it resolved by the Legislature of the state of Utah:
10 WHEREAS the Legislative Management Committee is created by law as a permanent
11 committee to receive and assign matters for the interim study of the Legislature; and
12 WHEREAS the 52nd Legislature has determined that certain legislative issues require
13 additional investigation and study:
14 NOW, THEREFORE, BE IT RESOLVED that the Legislative Management Committee
15 assign to the appropriate interim committee the duty to study and make recommendations for
16 legislative action they consider necessary to the 52nd Legislature in the 1998 General Session, or
17 earlier if indicated, from, but not limited to, the following items of study.
18 BE IT FURTHER RESOLVED that the Legislative Management Committee, in making
19 study assignments from this list and in approving study requests for individual committees, give
20 due regard to the available time of legislators and the budget and capacity of staff to respond
21 adequately to the number and complexity of the assignments given.
22 1. Adequacy of Capital Improvements - to study the adequacy of the capital improvement
23 (AR & I) formula as currently in Subsection 63A-5-103(8).
24 2. Adult High School Completion - to study whether to modify the basis on which school
25 districts receive their pro rata share of the Adult High School appropriation. (SB 158)
26 3. Appropriation for Tooele School District Schools - to study whether an appropriation
27 should be made to expand the technological capabilities of Tooele School District schools. (HB
1 375; intent language, HB 405)
2 4. Appropriations Intent Language - to study higher education appropriations intent
3 language (faculty work load, FTE counts, enrollment).
4 5. Budget Task Force - to study the creation of a task force that would conduct an in-depth
5 analysis of a different state agency budget each year. (SB 22)
6 6. Categorical Funding of Education Dollars - to study and review the increase in
7 categorical funds in the education budget.
8 7. Construction and Maintenance of UDOT Buildings - to study UDOT and DFCM
9 relationships in construction and maintenance of UDOT buildings.
10 8. Fiscal Prioritization - to study legislative rules on access to the fiscal prioritization
11 process. (SJR 8)
12 9. Funding Capital Improvements - to study increasing the formula for set aside funds for
13 capital improvements.
14 10. Governor's Budget Requirements - to study whether to require the Governor to include
15 in the budget for the Department of Human Services cost-of-living increases for private providers
16 with the Division of Child and Family Services and the Division of Youth corrections. (HB 388)
17 11. Impact of Bills on Local Government - to study whether to add a note to all legislative
18 bills stating their impact on local government.
19 12. Schools for the Deaf and Blind Funding - to study whether to fund schools for the deaf
20 and blind on a WPU basis rather than the line item, and whether to add an enhanced WPU for
21 single and multiple disabilities.
22 13. Use of Arts Funding - to study the allocation of state funds for the arts to verify the
23 appropriateness of the receiving entity.
24 14. Wildlife Resources Fee Schedule - to study and review the fee schedule for the
25 Division of Wildlife Resources.
26 15. Application to Noncommercial Projects - to study whether to create qualification
27 requirements for plans examiners and building officials and whether they should apply to
28 noncommercial projects. (Sub SB 135)
29 16. Beer Industry Fair Dealing Act - to study the feasibility of enacting a Beer Industry
30 Fair Dealing Act. (1st Sub SB 157)
31 17. Beer Licensees - to study the relationship between licensed beer retailers, beer
1 wholesalers, and retail licensees in a three-tier system. (SB 160)
2 18. Conservation and Housing Trust Fund - to study issues relating to the establishment
3 of a Utah Conservation and Housing Trust Fund.
4 19. Debt Collection - to study issues related to the Office of State Debt Collection.
5 20. Demand Drafts for Banks - to study methods to allow bank account holders to stop

19 27. Insurance Underwriting Practices - to study ways of prohibiting discriminatory
20 underwriting practices of insurance companies.
21 28. Land Survey - to study the state's land survey statutes.
22 29. Licensing of Engineers and Land Surveyors - to study amendments to professional

24 30. Limited Liability - to study the possible adoption of a Uniform Limited Liability
25 Company Act and related issues.
26 31. Master Deeds of Trust - to study issues related to master deeds of trust.
27 32. Mental Health Insurance Regulation - to study whether to require the Commissioner
28 of Insurance to issue rules regarding mental health insurance. (HB 193)
29 33. Nonlicensed Geologists - to study whether to permit a geologist to practice his
30 profession without violating licensing laws and without having to establish geology as a licensed
31 profession under the Department of Commerce. (1st Sub SB 169)
1 34. Olympic Repayment - to study whether the scheduled dates of repayment by the Salt
2 Lake Organizing Committee for the purchase of the Winter Sports Park should be modified.
3 35. Privatization of Workers' Compensation Fund - to study whether the fund should be
4 allowed to privatize and what the state would do to replace it as the provider of last resort.
5 36. Professional Licensure Restrictions - to study whether to require licensed
6 professionals, who have been issued restricted or probationary licenses, to disclose the restrictions
7 or conditions of their license to clients, patients, customers, consumers, etc.
8 37. Real Property Improvement Agreements - to study real property improvement
9 agreements including the perspectives of contractors, subcontractors, owners, and insurers. (HB

9 reflecting achievement and what tests are most valid.

13 56. Extracurricular Activities - to study the possibility of developing a uniform measuring

18 safety funding at state owned colleges and universities, which are currently subject to budget cuts
19 from higher education.

21 education.
22 60. Impact of Extracurricular Activities - to study the impact of extracurricular activities
23 on schools, particularly in rural areas.
24 61. Improved Teaching - to study ways to improve the quality of teaching in Utah.

26 teaching applications for instruction and discipline through inservice programs.
27 63. JAG Program - to study issues related to the JAG Program.
28 64. Postsecondary Comprehensive Guidance - to study and review the need for a
29 comprehensive guidance and counseling program in the colleges and universities with the
30 objective of reducing the time typically required to graduate from a postsecondary institution.
31 65. Pro Rata Shares of Adult High School Appropriation - to study whether to modify the
1 basis on which school districts receive their pro rata share of the adult high school appropriation.

21 and the Judicial Code regarding HIV testing procedures following the significant exposure of an

24 92. Penalties for Sale of Tobacco to Youth - to study the enhancement of civil penalties

27 regarding tobacco sales to underage persons.
28 93. Poison Control Needs - to study cost of living increase needs for poison control.

9 for small utility trailers that are now exempt but which contribute to wear and tear on roads and

11 198. Safety Inspection Fees - to study whether to increase vehicle safety inspection fees.
12 199. Safety Projects - to study transportation safety project needs and funding.
13 200. Selling of Rights of Way - to study the feasibility of having the state purchase excess
14 rights of way and resell them at higher value after road construction is complete in order to boost
15 funding capabilities, and the feasibility of placing restrictive covenants on the use of the property
16 in case the property may be needed in the future for expansion.
17 201. Speed Limits - to study speed limits for large trucks.
18 202. Speeding in Construction Zones - to study whether to implement increased fines for
19 speeding in construction zones.
20 203. Toll Roads - to study the privatization of toll roads.
21 204. UDOT and Local Governments - to study UDOT's relationship with local
22 government, such as local flexibility, jurisdictional transfers, etc.
23 205. UDOT Bicycle Plan - to study issues related to the development of a UDOT bicycle
24 plan.
