6    AN ACT RELATING TO HIGHER EDUCATION; MODIFYING THE WICHE
7    COMMISSIONERS' DUTIES AND THE RESIDENCY REQUIREMENTS FOR
8    ACCEPTABLE CANDIDATES TO THE WICHE PROGRAM.
9    This act affects sections of Utah Code Annotated 1953 as follows:
10    AMENDS:
11         53B-4-103, as enacted by Chapter 167, Laws of Utah 1987
12    Be it enacted by the Legislature of the state of Utah:
13        Section 1. Section 53B-4-103 is amended to read:
14         53B-4-103. Commissioners -- Duties -- Records of academic progress -- Cancellation
15     of student registration.
16        (1) The commissioners are the three resident members from the state of Utah, required by
17    Article IV of the compact, and are authorized to function as representatives of the state on the
18    Western Interstate Commission for Higher Education.
19        (2) The commissioners' duties are as follows:
20        (a) to study the need for professional and graduate educational facilities not available
21    within this state;
22        (b) to recommend appropriations to meet the needs of this act;
23        (c) to provide for [interviewing and] screening of all applicants for professional, graduate,
24    or higher educational study not available within the state in accordance with established rules; and
25        (d) to certify to out of state institutions under the compact all acceptable candidates.
26        (3) An applicant may not be certified unless [he or his parents have] the applicant has been
27    a bona fide [residents] resident of the state for at least the five years [previous] prior to the date of


1    application [date].
2        (4) (a) Students must maintain continuous Utah residency during their attendance at an out
3    of state institution in order to receive financial support under the compact.
4        (b) If Utah residency is terminated by a student during any academic year in which the
5    student has received financial support under the compact, the support shall be relinquished and
6    terminated at the end of that academic year.
7        [(3)] (5) (a) The Commissioner of Higher Education shall maintain records of the
8    academic progress of Utah students receiving financial support under the compact while attending
9    out of state institutions.
10        (b) If the records reveal a student is not progressing satisfactorily, upon recommendation
11    of the out of state institution, the commissioner shall cancel the student's registration and withhold
12    future payments otherwise due.
