             17      AN ACT RELATING TO HIGHER EDUCATION; PROVIDING FOR THE ESTABLISHMENT
             18      OF SNOW COLLEGE SOUTH IN RICHFIELD, UTAH, AS AN INTEGRATED PART OF
             19      SNOW COLLEGE; PROVIDING FOR ADMINISTRATION OF THE INSTITUTION BY
             20      SNOW COLLEGE; REQUIRING THE STATE BOARD OF REGENTS TAKE
             21      APPROPRIATE ACTION TO ENSURE A SUCCESSFUL TRANSITION OF THE SEVIER
             22      VALLEY APPLIED TECHNOLOGY CENTER INTO SNOW COLLEGE SOUTH;
             23      PROVIDING FOR THE INSTITUTION'S ROLE; AND PROVIDING AN EFFECTIVE
             24      DATE.
             25      This act affects sections of Utah Code Annotated 1953 as follows:
             26      ENACTS:
             27          53B-16-205, Utah Code Annotated 1953
             28      This act enacts uncodified material.


             1      Be it enacted by the Legislature of the state of Utah:
             2          Section 1. Section 53B-16-205 is enacted to read:
             3          53B-16-205. Establishment of Snow College South -- Supervision and administration
             4      -- Transition -- Institutional mission.
             5          (1) There is hereby established a higher education institution in Richfield, Utah, hereafter
             6      referred to as Snow College South.
             7          (2) Snow College shall administer the institution under the general control and supervision
             8      of the State Board of Regents as an integrated part of Snow College's mission, programs, and
             9      curriculum to include Snow College South's mission, programs, and curriculum.
             10          (3) (a) In conjunction with the establishment of Snow College South, the facilities, staff,
             11      and programs at the Sevier Valley Applied Technology Center in Richfield shall become a part
             12      of the state system of higher education and the structure from which Snow College South shall
             13      begin its operations.
             14          (b) The State Board of Regents shall take the appropriate action required to assure the
             15      successful transition of the applied technology center and its faculty and staff into the state system
             16      of higher education, including, if necessary:
             17          (i) creating and recording any conveyances needed for the transfer of property; and
             18          (ii) providing procedures for assimilating the center's faculty into the rank and tenure
             19      structure of Snow College.
             20          (4) (a) Snow College South shall maintain a strong curriculum in applied technology and
             21      technical courses of a general nature which can be transferred to other institutions within the
             22      higher education system, together with lower division courses of a general nature and courses
             23      required for associate degrees in science, arts, and applied science h , AND SHALL WORK WITH LOCAL
             23a      SCHOOL DISTRICTS IN DEVELOPING AN AGGRESSIVE CONCURRENT ENROLLMENT PROGRAM h .
             24          (b) The institution may confer certificates of completion and degrees as determined by the
             25      State Board of Regents within the parameters referred to in Subsection (4)(a).
             26          (c) The institution shall also provide for open entry-open exit h APPLIED TECHNOLOGY
             26a      EDUCATION h programs h THAT EMPHASIZE SHORT-TERM JOB TRAINING OR RETRAINING FOR
             26b      IMMEDIATE PLACEMENT IN THE JOB MARKET h .
             27          (d) The institution h [ may ] SHALL h make provisions for students h , INCLUDING HIGH
             27a      SCHOOL STUDENTS, h to take classes for which college

             28      credit is not awarded, together with appropriate fees for taking such classes.
             29          (e) The institution may request and receive a waiver from the State Board of Regents or
             30      the president of Snow College of any board rule or institutional policy that would prevent or
             31      inhibit Snow College South from achieving its performance goals, unless approval of the request

             1      would conflict with state or federal law or put the institution out of compliance with matters
             2      related to health, safety, civil rights, and insurance.
             3          Section 2. Funding for Snow College South.
             4          (1) The budgetary appropriation traditionally made for the Sevier Valley Applied
             5      Technology Center shall be transitioned to Snow College South for the fiscal year beginning July
             6      1, h [ 1998 ] 1999 h .
             7          (2) For the fiscal year beginning July 1, h [ 1999 ] 2000 h , and for each fiscal year thereafter the
             8      appropriation to fund Snow College South shall be a line item appropriation under higher
             9      education in the Appropriations Act.
             9a           h Section 3. Intent language.
             9b          (1) (a) IT IS THE INTENT OF THE LEGISLATURE THAT THE STATE BOARD OF REGENTS AND THE
             9c      STATE BOARD OF EDUCATION WORK TOGETHER WITH THE ADMINISTRATION AT SNOW COLLEGE AND
             9d      SEVIER VALLEY APPLIED TECHNOLOGY CENTER'S BOARD OF DIRECTORS, ADMINISTRATION, AND
             9e      FACULTY TO DEVELOP POLICIES AND PROCEDURES FOR A SUCCESSFUL TRANSITION OF THE
             9f      CENTER TO SNOW COLLEGE SOUTH, DEALING WITH SUCH ISSUES AS:
             9g          (i) MAINTAINING THE CENTER'S EMPHASIS ON APPLIED TECHNOLOGY EDUCATION AND JOB
             9h      TRAINING AS SNOW COLLEGE SOUTH;
             9i          (ii) PROVIDING FOR SUFFICIENT ONGOING FUNDING FOR THE INSTITUTION;
             9j          (iii) THE RETENTION OF CURRENT STAFF; AND
             9k          (iv) OPEN ACCESS TO THE INSTITUTION BY THOSE SEEKING TO IMPROVE THEIR LIVES
             9l      THROUGH CONTINUING EDUCATION.
             9m          (b) THE BOARD SHALL ALSO SEEK ADVICE FROM SELECTED LEGISLATORS FROM THE REGION
             9n      IN DEVELOPING THE POLICIES AND PROCEDURES.
             9o          (2) IT IS THE FURTHER INTENT OF THE LEGISLATURE THAT:
             9p          (a) THE TRANSITION SHOULD BE COMPLETED BY JANUARY 1, h [ 1999 ] 2000 h ;
             9q          (b) THE CURRENT BOARD OF DIRECTORS AND CURRENT ADMINISTRATION AT THE
             9r      INSTITUTION SHOULD CONTINUE TO FUNCTION UNTIL JUNE 30, h [ 1999 ] 2000 h ; AND
             9s          (c) STUDENT FEES SHOULD NOT INCREASE AS A RESULT OF THE TRANSITION. h
             10          Section h [ 3 ] 4 h . Effective date.
             11          This act takes effect on July 1, h [ 1998 ] 1999 h .
