APPROPRIATION FOR LAND USE PLANS

    AN ACT RELATING TO COUNTIES AND OTHER LOCAL GOVERNMENTS;
    APPROPRIATING $175,000 TO THE OFFICE OF PLANNING AND BUDGET TO
    DISTRIBUTE TO COUNTIES AND OTHER LOCAL GOVERNMENTS AS MATCHING
    FUNDS FOR THE DEVELOPMENT AND IMPLEMENTATION OF LAND USE PLANS
    AND TO SOUTHERN UTAH UNIVERSITY TO CONDUCT WORKSHOPS ON LAND
    PLANNING.
    This act enacts uncodified material.
    Be it enacted by the Legislature of the state of Utah:
        Section 1. Intent.
        The Legislature finds that the value of property throughout the state is enhanced by
    appropriate land-use planning by the counties and other local governments, that revenues to the
    state depend to a significant extent on the value of the property generating those revenues, and that
    the quality of land-use planning improves with training and education. It is the intent of the
    Legislature in appropriating these funds to help meet the statewide need for training and education
    of county, local, and state officials involved in land-use planning activities to improve the quality
    of land-use planning.
        Section 2. Appropriation.
        (1) (a) There is appropriated from the General Fund for fiscal year 1998-99, $175,000 to
    the Office of Planning and Budget.
        (b) The Office of Planning and Budget shall:
        (i) distribute up to $10,000 of the appropriated funds to Southern Utah University for use
    by its Utah Center for Rural Life to conduct workshops on preparation of land-use plans, including
    protection of private property rights and other rights attached to property;
        (ii) determine, in conjunction with the Utah Association of Counties, the counties and
    other local governments most qualified to receive the remainder of the appropriated funds to assist


    in developing and implementing land-use plans, based on criteria established by the Office of
    Planning and Budget;
        (iii) consider the recommendations of the Governor's Rural Partnership Board in determining
    the counties and other local governments most qualified to receive funds under Subsection (1)(b)(ii);
        (iv) receive the recommendation of the Governor's Local Government Comprehensive
    Planning Project Steering Committee in establishing the criteria that are the basis of the
    determination of the counties and other local governments most qualified to receive funds under
    Subsection (1)(b)(ii); and
        (v) distribute the remaining funds to counties and other local governments that:
        (A) meet the criteria established by the Office of Planning and Budget;
        (B) match the amount distributed by the Office of Planning and Budget in funds or in kind;
        (C) agree to encourage county, local, and state officials involved with land-use planning to
    attend the workshops; and
        (D) agree to review and, if necessary, revise the comprehensive general plan at least
    annually.
        (c) In planning and presenting the workshops provided under Subsection (1)(b)(i), Southern
    Utah University, through its Utah Center for Rural Life, may involve county and other local
    government officials who are preparing or have completed a land-use plan.
        (2) These appropriations are nonlapsing.
