UTAH NATIONAL GUARD TUITION ASSISTANCE

    AN ACT RELATING TO MILITIAS AND ARMORIES; PROVIDING FOR TUITION
    ASSISTANCE FOR ACTIVE NATIONAL GUARD MEMBERS ATTENDING
    POSTSECONDARY INSTITUTIONS, INCLUDING APPLIED TECHNOLOGY CENTERS;
    APPROPRIATING $100,000; MAKING TECHNICAL CORRECTIONS; AND PROVIDING
    AN EFFECTIVE DATE.
    This act affects sections of Utah Code Annotated 1953 as follows:
    AMENDS:
         39-1-63, as last amended by Chapter 144, Laws of Utah 1979
    Be it enacted by the Legislature of the state of Utah:
        Section 1. Section 39-1-63 is amended to read:
         39-1-63. Tuition assistance for National Guard members -- Use and allocation --
     Appropriation.
        (1) [There shall be available to individual members of the] The Utah National Guard
    [scholarships] may provide tuition assistance to members for [undergraduate] study at
    postsecondary institutions of learning, including Applied Technology Centers, subject to the
    following requirements:
        (a) The individual must be, at the time he or she receives the [benefits] assistance, an
    active member of the Utah National Guard.
        (b) The [benefit hereunder shall be] assistance is for tuition only and shall be [equal to]
    not more than the resident tuition for the actual course of postsecondary study engaged in by the
    individual.
        [(c) The scholarship shall be payable only to individuals not eligible to receive scholastic
    financial assistance from the federal government by reason of having been a member of the armed
    forces of the United States.]
        (2) Tuition assistance shall be awarded for each academic year. Students may apply to the


    adjutant general for assistance for each year during which he or she is an active member of the Utah
    National Guard. In awarding assistance, the adjutant general shall consider the recruitment and
    retention needs of the National Guard.
        [(2)] (3) [Scholarships provided hereunder are] Tuition assistance is to be paid by the
    adjutant general of the state [of Utah] directly to the institutions involved from the [fund] funds
    appropriated [hereunder].
        [(3)] (4) The adjutant general of the state [of Utah] shall [have the power to] establish [such]
    regulations, procedures, forms, and reports [as are] necessary to administer the allocation of
    [scholarships] assistance and [payments] payment of funds under this [act] section.
        [(4) There is appropriated annually to the adjutant general out of the General Fund the sum
    of not to exceed $25,000 as specified in the annual appropriation bill. These funds shall be expended
    for the granting of scholarships in accordance with this act.]
        (5) The adjutant general shall include a request each year for funds for this program in the
    annual budget for the National Guard.
        (6) A person who transfers from the Select Reserve to the National Guard is not eligible for
    the tuition assistance in this section for one year from the date of transfer.
        Section 2. Appropriation.
        There is appropriated from the Uniform School Fund for fiscal year 1998-99 $100,000 to the
    Utah National Guard to be used for post-secondary education tuition assistance for active members
    of the National Guard.
        Section 3. Effective date.
        This act takes effect on July 1, 1998.
