5 AN ACT RELATING TO PUBLIC EDUCATION; PROVIDING FOR AT LEAST A BIENNIAL
6 REVIEW AND UPDATE OF A SCHOOL DISTRICT'S EDUCATOR EVALUATION
7 PROGRAM, WITH A FOCUS ON IDENTIFYING, IMPROVING, AND REWARDING
8 EDUCATIONAL EXCELLENCE; PROVIDING FOR ANNUAL INFORMAL
9 EVALUATIONS OF CAREER SERVICE EDUCATORS; AND PROVIDING FOR FORMAL
10 WRITTEN EVALUATIONS EVERY THREE YEARS.
11 This act affects sections of Utah Code Annotated 1953 as follows:
12 AMENDS:
13 53A-10-104, as enacted by Chapter 2, Laws of Utah 1988
14 ENACTS:
15 53A-10-103.5, Utah Code Annotated 1953
16 Be it enacted by the Legislature of the state of Utah:
17 Section 1. Section 53A-10-103.5 is enacted to read:
18 53A-10-103.5. Review and revision of evaluation program.
19 (1) Each local school board shall provide for a periodic review and updating of its
20 evaluation program established under Section 53A-10-103.
21 (2) The review shall occur on at least a biennial basis and focus on identifying, improving,
22 and rewarding educational excellence as an integral part of the program.
23 (3) If the district uses an evaluation instrument in its program, it shall:
24 (a) determine as part of its review whether the instrument is an effective tool in identifying
25 excellence in the individual being evaluated; and
26 (b) make revisions in the instrument if those revisions will enhance the program.
27 (4) The board may use the joint committee established under Section 53A-10-103 or a
1 similar group comprised of classroom teachers and administrators to assist them in their review.
2 Section 2. Section 53a-10-104 is amended to read:
3 53A-10-104. Frequency of evaluations.
4 (1) A local school board shall provide for the evaluation of its provisional and
5 probationary educators at least twice each school year.
6 (2) (a) A local school board shall provide for informal annual evaluations of its career
7 service educators.
8 (b) These evaluations shall include an opportunity for each career service educator to set
9 achievable professional performance goals.
10 (3) Each career service educator shall receive a formal written evaluation at least once
11 every three years.
12 (4) The evaluations shall focus on identifying, rewarding, and improving educational
13 excellence.
