5    AN ACT RELATING TO COMMUNITY AND ECONOMIC DEVELOPMENT; ALLOWING
6    PER DIEM AND EXPENSES FOR THE NAVAJO REVITALIZATION FUND BOARD;
7    AND MAKING TECHNICAL CORRECTIONS.
8    This act affects sections of Utah Code Annotated 1953 as follows:
9    AMENDS:
10         9-11-105, as enacted by Chapter 135, Laws of Utah 1996
11    Be it enacted by the Legislature of the state of Utah:
12        Section 1. Section 9-11-105 is amended to read:
13         9-11-105. Navajo Revitalization Fund Board created -- Members -- Terms -- Chair
14     -- Expenses.
15        (1) There is created within the division the Navajo Revitalization Board composed of five
16    members as follows:
17        (a) the governor or the governor's designee;
18        (b) the two members of the San Juan County commission whose districts include portions
19    of the Navajo Reservation;
20        (c) the chair of the Navajo Utah Commission or a member of the commission designated
21    by the chair; and
22        (d) the chair of the Utah Dineh Committee, as created in Section 63-88-107, or a member
23    of the committee designated by the chair.
24        (2) The terms of office for the members of the board shall run concurrently with the terms
25    of office for the governor, county commissioners, member of the Navajo Utah Commission, and
26    member of the Utah Dineh Committee.
27        (3) The governor, or the governor's designee, shall be the chair of the board and the chair


1    is responsible to call necessary meetings.
2        (4) (a) (i) [Members of the board shall serve without compensation except the members
3    shall receive travel expenses as determined by the Division of Finance in Section 63A-3-107.
4    These travel expenses] Members who are not government employees of the state or local
5    government shall receive no compensation or benefits for their services, but may receive per diem
6    and expenses incurred in the performance of the member's official duties at the rates established
7    by the Division of Finance under Sections 63A-3-106 and 63A-3-107.
8        (ii) Members may decline to receive per diem and expenses for their service.
9        (b) (i) State government officer and employee members who do not receive salary, per
10    diem, or expenses from their agency for their service may receive per diem and expenses incurred
11    in the performance of their official duties from the committee at the rates established by the
12    Division of Finance under Sections 63A-3-106 and 63A-3-107.
13        (ii) State government officer and employee members may decline to receive per diem and
14    expenses for their service.
15        (c) (i) Local government members who do not receive salary, per diem, or expenses from
16    the entity that they represent for their service may receive per diem and expenses incurred in the
17    performance of their official duties at the rates established by the Division of Finance under
18    Sections 63A-3-106 and 63A-3-107.
19        (ii) Local government members may decline to receive per diem and expenses for their
20    service.
21        (d) The per diem and expenses permitted under this Subsection (4) may be included as
22    costs of administration of the fund.
23        (5) Four board members are a quorum.
24        (6) Any board decisions related to monies in or disbursed from the fund requires the
25    affirmative vote of each member of the board present at a meeting when a quorum is present.
