5 AN ACT RELATING TO OCCUPATIONS AND PROFESSIONS; REVISING THE
6 EDUCATIONAL REQUIREMENTS FOR LICENSURE AS A PROFESSIONAL ENGINEER.
7 This act affects sections of Utah Code Annotated 1953 as follows:
8 AMENDS:
9 58-22-302, as repealed and reenacted by Chapter 259, Laws of Utah 1996
10 Be it enacted by the Legislature of the state of Utah:
11 Section 1. Section 58-22-302 is amended to read:
12 58-22-302. Qualifications for licensure.
13 (1) Each applicant for licensure as a professional engineer shall:
14 (a) submit an application in a form prescribed by the division;
15 (b) pay a fee determined by the department under Section 63-38-3.2;
16 (c) provide satisfactory evidence of good moral character;
17 (d) (i) have graduated and received an earned bachelors or masters degree from an
18 engineering program meeting criteria established by rule by the division in collaboration with the
19 board; or
20 (ii) have completed the Transportation Engineering Technology and Fundamental
21 Engineering College Program prior to July 1, 1998, under the direction of the Utah Department
22 of Transportation and as certified by the Utah Department of Transportation;
23 (e) have successfully completed a program of qualifying experience established by rule
24 by the division in collaboration with the board;
25 (f) have successfully passed examinations established by rule by the division in
26 collaboration with the board; and
27 (g) meet with the board or representative of the division upon request for the purpose of
1 evaluating the applicant's qualification for licensure.
2 (2) Each applicant for licensure as a professional structural engineer shall:
3 (a) submit an application in a form prescribed by the division;
4 (b) pay a fee determined by the department under Section 63-38-3.2;
5 (c) provide satisfactory evidence of good moral character;
6 (d) have graduated and received an earned bachelors or masters degree from an
7 engineering program meeting criteria established by rule by the division in collaboration with the
8 board;
9 (e) have successfully completed three years of licensed professional engineering
10 experience established by rule by the division in collaboration with the board;
11 (f) have successfully passed examinations established by rule by the division in
12 collaboration with the board; and
13 (g) meet with the board or representative of the division upon request for the purpose of
14 evaluating the applicant's qualification for licensure.
15 (3) Each applicant for licensure as a professional land surveyor shall:
16 (a) submit an application in a form prescribed by the division;
17 (b) pay a fee determined by the department under Section 63-38-3.2;
18 (c) provide satisfactory evidence of good moral character;
19 (d) have graduated and received an earned associates, bachelors, or masters degree from
20 a land surveying program, or an equivalent land surveying program, established by rule by the
21 division in collaboration with the board; or
22 (e) have successfully completed a program of qualifying experience in land surveying
23 established by rule by the division in collaboration with the board;
24 (f) have successfully completed a program of qualifying experience in land surveying
25 established by rule by the division in collaboration with the board, which experience is in addition
26 to any experience obtained in Subsection (3)(e);
27 (g) have successfully passed examinations established by rule by the division in
28 collaboration with the board; and
29 (h) meet with the board or representative of the division upon request for the purpose of
30 evaluating the applicant's qualification for licensure.
31 (4) Each applicant for licensure by endorsement shall:
1 (a) submit an application in a form prescribed by the division;
2 (b) pay a fee determined by the department under Section 63-38-3.2;
3 (c) provide satisfactory evidence of good moral character;
4 (d) submit satisfactory evidence of:
5 (i) current licensure in good standing in a jurisdiction recognized by rule by the division
6 in collaboration with the board; and
7 (ii) have successfully passed any examination established by rule by the division in
8 collaboration with the board; and
9 (iii) full-time employment as a licensed professional engineer, professional structural
10 engineer, or professional land surveyor as a principal for at least five of the last seven years
11 immediately preceding the date of the application; and
12 (e) meet with the board or representative of the division upon request for the purpose of
13 evaluating the applicant's qualifications for license.
