6    AN ACT RELATING TO SPECIAL DISTRICTS; AND REQUIRING WATER
7    CONSERVANCY DISTRICTS TO PREPARE AND DISTRIBUTE A WATER
8    CONSERVATION PLAN.
9    This act affects sections of Utah Code Annotated 1953 as follows:
10    ENACTS:
11         17A-2-1455, Utah Code Annotated 1953
12    Be it enacted by the Legislature of the state of Utah:
13        Section 1. Section 17A-2-1455 is enacted to read:
14         17A-2-1455. Water conservation plan required.
15        (1) As used in this section:
16        (a) "Retail" means the level of water distribution that supplies water directly to the end
17    user.
18        (b) (i) "Water conservation plan" means a written document that contains ideas,
19    suggestions, or recommendations as to what can be done by the state and local governments, a
20    district under this part, a retail water provider, and the end user of water to help conserve water and
21    limit or reduce its use in the state in terms of per capita consumption so that adequate supplies of
22    water are available for future needs.
23        (ii) A "water conservation plan" shall contain recommendations for water saving measures
24    that may include:
25        (A) the installation and use of water efficient fixtures and appliances, including toilets,
26    shower fixtures, and faucets;
27        (B) residential and commercial landscapes and irrigation that require less water to


1    maintain;
2        (C) more water efficient industrial and commercial processes involving the use of water;
3        (D) water reuse systems, both potable and not potable;
4        (E) distribution system leak repair;
5        (F) dissemination of public information regarding more efficient use of water, including
6    public education programs, customer water use audits, and water saving demonstrations;
7        (G) water rate structures designed to encourage more efficient use of water;
8        (H) statutes, ordinances, codes, or regulations designed to encourage more efficient use
9    of water by means such as water efficient fixtures and landscapes; and
10        (I) incentives to implement water efficient techniques, including rebates to water users to
11    encourage the implementation of more water efficient measures.
12        (2) Before June 1, 1999, each district under this part shall:
13        (a) prepare a water conservation plan and a one-page summary of its contents;
14        (b) devote part of at least one regular meeting of the board of directors to a discussion of
15    the water conservation plan and allow public comment on it;
16        (c) at least one week before the board of directors meeting under Subsection (2)(b), deliver
17    a copy of the water conservation plan and summary to each newspaper of general circulation
18    within the district and other media outlets serving the area of the district; and
19        (d) mail a copy of the water conservation plan and summary to:
20        (i) the legislative body of each county and municipality in which any part of the district
21    is located;
22        (ii) the speaker and the minority party leader of the House of Representatives and the
23    president and minority party leader of the Senate;
24        (iii) the state engineer; and
25        (iv) the governor.
