SERIOUSLY IMPACTED BUSINESSES

6    A JOINT RESOLUTION OF THE LEGISLATURE ENCOURAGING THE PROCUREMENT
7    BOARD TO ALLOW AS PART OF THE PROCUREMENT PROCESS CONSIDERATION
8    OF THE IMPACT ON BUSINESS OF MAJOR HIGHWAY CONSTRUCTION AND
9    ENCOURAGING STATE PROCUREMENT UNITS TO PURCHASE FROM BUSINESSES
10    IMPACTED BY MAJOR HIGHWAY CONSTRUCTION.
11    Be it resolved by the Legislature of the state of Utah:
12        WHEREAS construction on I-15 has seriously impacted businesses in the I-15 corridor;
13        WHEREAS because of these impacts businesses in the corridor have lost business and
14    revenue;
15        WHEREAS the preservation of existing businesses is as important to Utah as the attracting
16    of new businesses;
17        WHEREAS with the loss of revenue many significantly impacted businesses may not be
18    able to survive until access to their business is restored to at least preconstruction levels;
19        WHEREAS the state through its purchasing power could provide opportunities to
20    businesses that would replace in part the loss of revenue resulting from the state's I-15 construction
21    project;
22        WHEREAS the I-15 construction project has highlighted the impacts to businesses of
23    major highway construction and therefore the need for a mechanism to assist businesses to be in
24    place when the state initiates major highway construction;
25        WHEREAS H.B. 141, Mitigation to Businesses Impacted by Major Highway Construction,
26    provides technical assistance to seriously impacted businesses in the procurement process and
27    information to procurement units about seriously impacted businesses; and


1        WHEREAS successful implementation of H.B. 141 is dependent in part on state
2    procurement units' ability and willingness to purchase from businesses seriously impacted by
3    major highway construction:
4        NOW, THEREFORE, BE IT RESOLVED that the Legislature of the state of Utah urges
5    the State Procurement Policy Board to establish rules that permit procurement units to give
6    consideration to whether a bidder has been seriously impacted by major highway construction in
7    awarding and inviting bids for small purchases.
8        BE IT FURTHER RESOLVED that state procurement units whenever practicable give
9    consideration to seriously impacted businesses in awarding and inviting bids.
10        BE IT FURTHER RESOLVED that copies of this resolution be sent to the State
11    Procurement Policy Board and the chief procurement officer.
