APPROPRIATION FOR MOVING BOTANICAL GARDENS

                  AN ACT RELATING TO APPROPRIATIONS; APPROPRIATING $200,000 FROM THE
                  GENERAL FUND FOR FISCAL YEAR 1998-99 TO UTAH STATE UNIVERSITY FOR
                  RELOCATING A BOTANICAL CENTER; AND PROVIDING AN EFFECTIVE DATE.
                  This act enacts uncodified material.
                  Be it enacted by the Legislature of the state of Utah:
                      Section 1. Appropriation.
                      There is appropriated from the General Fund for fiscal year 1998-99, $200,000 to Utah
                  State University.
                      (2) (a) It is the intent of the Legislature that this appropriation shall be used for the
                  relocation of the Utah Botanical Garden from Farmington adjacent to U.S. Highway 89 to the site
                  in Kaysville which shall be known as the Utah Botanical Center.
                      (b) The relocation under Subsection (2)(a) includes installing infrastructure, transplanting
                  plant materials, establishing new plants, and establishing facilities at the new site.
                      (3) The money appropriated in Subsection (1) is nonlapsing.
                      Section 2. Effective date.
                      This act takes effect on July 1, 1998.
