5    AN ACT RELATING TO PUBLIC EDUCATION; REQUIRING THE STATE
6    SUPERINTENDENT OF PUBLIC INSTRUCTION TO PREPARE A REPORT ON
7    EXTRACURRICULAR ACTIVITIES EACH TIME SCHOOL DISTRICTS ARE
8    REALIGNED FOR INTERDISTRICT PLAY OR AT LEAST ONCE EVERY THREE
9    YEARS.
10    This act affects sections of Utah Code Annotated 1953 as follows:
11    AMENDS:
12         53A-1-301, as last amended by Chapter 152, Laws of Utah 1994
13    Be it enacted by the Legislature of the state of Utah:
14        Section 1. Section 53A-1-301 is amended to read:
15         53A-1-301. Appointment -- Qualifications -- Duties.
16        (1) The State Board of Education shall appoint a superintendent of public instruction,
17    hereinafter called the state superintendent, who is the executive officer of the board and serves at
18    the pleasure of the board. The board shall appoint the state superintendent on the basis of
19    outstanding professional qualifications. The state superintendent shall administer all programs
20    assigned to the State Board of Education in accordance with the policies and the standards
21    established by the board.
22        (2) The superintendent shall perform duties assigned by the board, including the following:
23        (a) investigating all matters pertaining to the public schools;
24        (b) adopting and keeping an official seal to authenticate the superintendent's official acts;
25    copies of authenticated documents shall be received as evidence in the courts of this state in the
26    same manner as originals;
27        (c) holding and conducting meetings, seminars, and conferences on educational topics;


1        (d) presenting to the governor and the Legislature each December a report of the public
2    school system for the preceding year to include:
3        (i) data on the general condition of the schools with recommendations considered desirable
4    for specific programs;
5        (ii) a complete statement of fund balances;
6        (iii) a complete statement of revenues by fund and source;
7        (iv) a complete statement of adjusted expenditures by fund, the status of bonded
8    indebtedness, the cost of new school plants, and school levies;
9        (v) a complete statement of state funds allocated to each of the state's 40 school districts
10    by source, including supplemental appropriations, and a complete statement of expenditures by
11    each district, including supplemental appropriations, by function and object as outlined in the U.S.
12    Department of Education publication Financial Accounting for Local and State School Systems;
13        (vi) a statement that includes such items as fall enrollments, average membership, high
14    school graduates, certificated and classified employees, pupil-teacher ratios, average salaries,
15    applicable private school data, and data from standardized norm-referenced tests in grades 5, 8,
16    and 11 on each school and district;
17        (vii) statistical information regarding incidents of delinquent activity in the schools or at
18    school-related activities with separate categories for:
19        (A) alcohol and drug abuse;
20        (B) weapon possession;
21        (C) assaults; and
22        (D) arson; and
23        (viii) other statistical and financial information about the school system which the
24    superintendent considers pertinent; and
25        (e) with the approval of the board, preparing and submitting to the governor a budget for
26    the board to be included in the budget that the governor submits to the Legislature.
27        (3) (a) (i) Each time the Utah High School Activities Association realigns interdistrict
28    competitions, or at least once every three years, the state superintendent shall prepare a report for
29    the Legislature and governor on the amount of class time missed by secondary school students and
30    faculty for extracurricular activities during that school year.
31        (ii) The report shall include the total number of individuals involved and the hours missed

1    per school district and the time involved, the total number of miles and school district costs for
2    transporting students and faculty to and from extracurricular activities.
3        (iii) The superintendent shall format the report into separate areas of activities to include:
4        (A) athletic contests;
5        (B) musical performances;
6        (C) forensic, debate, and speech competitions; and
7        (D) school club activities.
8        (b) The state board shall establish standardized reporting guidelines for school districts to
9    assist the superintendent in collecting the information required for the report.
10        (c) The superintendent shall present the first report by December 31, 1998.
11        [(3)] (4) Upon leaving office, the state superintendent shall deliver to his successor all
12    books, records, documents, maps, reports, papers, and other articles pertaining to his office.
