5 AN ACT RELATING TO THE LEGISLATURE; AMENDING THE PROVISION REQUIRING
6 STANDING COMMITTEES OF THE TWO HOUSES TO BE IDENTICAL; CHANGING
7 DEADLINE ON INTERIM COMMITTEE REPORTING; AND PROVIDING AN
8 EFFECTIVE DATE.
9 This act affects sections of Utah Code Annotated 1953 as follows:
10 AMENDS:
11 36-12-2, as enacted by Chapter 109, Laws of Utah 1975
12 36-12-5, as last amended by Chapter 47, Laws of Utah 1985
13 Be it enacted by the Legislature of the state of Utah:
14 Section 1. Section 36-12-2 is amended to read:
15 36-12-2. Standing committees.
16 Each house of the Legislature at the beginning of each general session shall organize itself
17 into standing committees for the consideration of proposed legislation. The committees shall be
18 organized, their duties determined, and their membership appointed as the rules of each house shall
19 prescribe[

21 special committees, or ad hoc committees which each house may organize.
22 Section 2. Section 36-12-5 is amended to read:
23 36-12-5. Duties of interim committees.
24 (1) It is the duty of each interim committee:
25 (a) to receive study assignments by resolution from the appropriate house of the
26 Legislature;
27 (b) to receive study assignments from its corresponding Senate or House Management
1 Committee, created under Section 36-12-6;
2 (c) to place matters on its study agenda upon notification to its Senate or House
3 Management Committee. If a study request has not been disapproved by the appropriate
4 management committee within 30 days of receipt of the request, the interim committee may
5 proceed with the requested study;
6 (d) to request research reports from the professional legislative staff pertaining to the
7 committee's agenda of study;
8 (e) to investigate and study possibilities for improvement in government services within
9 its subject area;
10 (f) to accept reports from the professional legislative staff and make recommendations for
11 legislative action with respect to such reports; and
12 (g) to prepare and recommend to the Legislature a legislative program in response to the
13 committee's study agenda.
14 (2) Reports and recommendations of the interim committees shall be completed and made
15 public [
16 are submitted. A copy of the reports and recommendations shall be mailed to each member or
17 member-elect of the Legislature, to each elective state officer, and to the state library.
18 Section 3. Effective date.
19 If approved by two-thirds of all the members elected to each house, this act takes effect
20 upon approval by the governor, or the day following the constitutional time limit of Utah
21 Constitution Article VII, Section 8, without the governor's signature, or in the case of a veto, the
22 date of veto override.
