6 AN ACT RELATING TO PUBLIC EDUCATION; PROVIDING THAT THE STATE BOARD
7 OF EDUCATION MAY MAKE RECOMMENDATIONS OR PROVIDE MODELS TO
8 LOCAL SCHOOL BOARDS AS TO THE GRADE LEVEL OR LEVELS AT WHICH
9 CURRICULUM SHOULD BE TAUGHT; AND PROVIDING THAT THE LOCAL BOARDS
10 MAY ADOPT THOSE MODELS OR RECOMMENDATIONS OR CHOOSE TO DESIGN
11 THEIR OWN INSTRUCTIONAL SCHEDULE.
12 This act affects sections of Utah Code Annotated 1953 as follows:
13 AMENDS:
14 53A-1-402, as enacted by Chapter 2, Laws of Utah 1988
15 Be it enacted by the Legislature of the state of Utah:
16 Section 1. Section 53A-1-402 is amended to read:
17 53A-1-402. Board to establish minimum standards for public schools.
18 (1) The State Board of Education shall establish rules and minimum standards for the
19 public schools, to include:
20 (a) the qualification and certification of educators and ancillary personnel who provide
21 direct student services, required school administrative and supervisory services, and evaluation of
22 instructional personnel;
23 (b) access to programs, attendance, competency levels, graduation requirements, discipline
24 and control, and health and safety requirements;
25 (c) school accreditation, the academic year, alternative and pilot programs, curriculum and
26 instruction requirements, school libraries, and services to the handicapped and other special
27 groups;
1 (d) requirements for school design, general educational specifications, school sites, and
2 building accessibility;
3 (e) state reimbursed bus routes, bus safety and operational requirements, and other
4 transportation needs; and
5 (f) school productivity and cost effectiveness measures, the minimum school program,
6 school building aid, school lunch, driver education, federal programs, school budget formats, and
7 financial, statistical, and student accounting requirements.
8 (2) The board shall determine whether the minimum standards have been met, and that
9 required reports are properly submitted.
10 (3) (a) In establishing minimum standards for graduation requirements under Subsection
11 (1)(b) and curriculum and instruction requirements under Subsection (1)(c), the board may
12 recommend or provide models as to the grade level or levels at which the instruction might be
13 given.
14 (b) A local school board has the option of adopting the recommendations or models
15 provided under Subsection (3)(a), or it may choose to design its own instructional schedule as to
16 the grade level or levels at which the instruction is given.
