Mr. Speaker:

    The Political Subdivisions Committee reports a favorable recommendation on H.B. 116, RESTRICTION ON STATE EMPLOYEES, by Representative J. Tanner, with the following amendments:

1.    Page 1, Line 18:    After "(1)" delete "A" and insert "Except as provided in subsection (3), a" and after "public employee" insert ", during the performance of the employee or officer's duties, within the scope of employment, or under color of authority,"

2.    Page 1, Line 24:    Delete lines 24 and 25 and insert
        "(3) This section does not apply to:
        (a) public officers or public employees intercepting communications as provided in Title 77, Section 23a, Interception of Communications;
        (b) peace officers as defined in Title 77, Chapter 1a, Peace Officer Designation; and
        (c) employees of public agencies and public safety agencies providing emergency telephone services as provided in Title 69, Chapter 2, Emergency Telephone Service Law."
