6 AN ACT RELATING TO TRANSPORTATION; CREATING THE STATE TRAFFIC AND
7 PEDESTRIAN SAFETY COORDINATING COUNCIL h ; AND PROVIDING A REPEAL DATE h .
8 This act affects sections of Utah Code Annotated 1953 as follows:

9 ENACTS:

11 Be it enacted by the Legislature of the state of Utah:
11a h Section 1. Section 63-55-272 is amended to read:
11b 63-55-272. Repeal dates, Title 72.
11c (1) Section 72-2-119, Growth Impact Highway Grants, is repealed July 1, 2001.
11d (2) SECTION 72-8-108, STATE TRAFFIC AND PEDESTRIAN SAFETY COORDINATING
11e COUNCIL, IS REPEALED JULY 1, 2003. h
12 Section 1. Section 72-8-108 is enacted to read:
13 72-8-108. State Traffic and Pedestrian Safety Coordinating Council -- Membership
14 -- Duties.
15 (1) As used in this section, "council" means the State Traffic and Pedestrian Safety
16 Coordinating Council created in this section.
17 (2) There is created within the Department of Transportation the State Traffic and
18 Pedestrian Safety Coordinating Council comprising:
19 (a) one member designated by the executive director of the department;
20 (b) one member designated by the executive director of the Department of Health;
21 (c) one member designated by the director of the Division of Aging and Adult Services
22 within the Department of Human Services;
23 (d) one member designated by the director of the Division of Services for People with
24 Disabilities within the Department of Human Services;
25 (e) one member designated by the Utah Association of Counties;
26 (f) one member designated by the Utah League of Cities and Towns;
27 (g) one member designated by each metropolitan planning organization in the state;

28 (h) one member designated by the Commissioner of Public Safety;
29 (i) one member designated by the Chief of Police Association;
30 (j) one member designated by the state Parent Teachers' Association;
31 (k) one member designated by the state superintendent of public instruction; h [ an d] h
32 (l) one member designated by the society of professional engineers who is a practicing
33 traffic or transportation engineer in the private sector h [ . ] ; AND
33a (m) ONE MEMBER DESIGNATED BY THE UTAH DIVISION OF INDIAN AFFAIRS. h
34 (3) The council shall:
35 (a) receive suggestions about traffic and pedestrian safety improvements and traffic safety
36 program measures;
37 (b) review the plans of various federal, state, and local governments relating to traffic and
38 pedestrian safety;
39 (c) promote traffic and pedestrian safety plans, projects, tools, and education throughout
40 the state;
41 (d) gather information and adopt recommended guidelines to aid state and local
42 governments, school districts, and the public on traffic and pedestrian safety issues in the
43 development of state and local government laws, ordinances, rules, and policies;
44 (e) exchange information and coordinate traffic and pedestrian safety plans among the
45 department, the state's political subdivisions, and school districts;
46 (f) exchange information and coordinate traffic and pedestrian safety plans among the
47 school traffic safety committees established in school districts under Section 53A-3-402 ;
48 (g) make recommendations to highway authorities on increasing the safety and efficiency
49 of highways using traffic and pedestrian safety plans;
50 (h) make recommendations to law enforcement agencies relating to traffic and pedestrian
51 safety; and
52 (i) make recommendations to school districts and others, on ways to promote traffic and
53 pedestrian safety education in the state.
54 (4) (a) The council shall annually elect a chair and a vice chair from its members.
55 (b) The council shall meet as it determines necessary to accomplish its duties.
56 (c) Reasonable notice shall be given to each member of the council prior to any meeting.
57 (d) A majority of the council constitutes a quorum for the transaction of business.
58 (e) Members shall receive no compensation or benefits for their services.

59 (f) The council may establish subcommittees as needed to assist in accomplishing its duties
60 under this section.
61 (5) The department shall provide staff support for the council.
62 (6) The department shall consider traffic and pedestrian safety accommodation in the
63 planning, design, construction, and maintenance of all transportation facilities under its
64 jurisdiction.
