             10      AN ACT RELATING TO HIGHER EDUCATION; REQUIRING THE STATE BOARD OF
             11      REGENTS AS PART OF ITS MASTER PLANNING TO REVIEW THE ROLE AND MISSION
             12      OF DIXIE COLLEGE AS RELATED TO OFFERING A LIMITED NUMBER OF
             13      BACCALAUREATE PROGRAMS AT THE COLLEGE; PROVIDING FOR A REPORT;
             14      PROVIDING FOR THE CONTENT OF THE REPORT; PROVIDING FOR THE TRANSFER
             15      OF UNIVERSITY CENTER PROGRAM MONIES; PROVIDING FOR THE ESTABLISHMENT
             16      OF BACCALAUREATE PROGRAMS AT DIXIE COLLEGE; PROVIDING FOR FUNDING
             17      OF THOSE PROGRAMS; PROVIDING FOR A NAME CHANGE; AND PROVIDING AN
             18      EFFECTIVE DATE.
             19      This act enacts uncodified material.
             20      Be it enacted by the Legislature of the state of Utah:
             21          Section 1. Baccalaureate programs at Dixie College -- Subject to review and report
             22      -- Transfer of University Center funding -- Foundation contribution.
             23          (1) (a) The State Board of Regents, in consultation with Dixie College's president and
             24      board of trustees and subject to the review and report required under Subsections (2) and (3), shall:
             25          (i) establish a minimum of three baccalaureate programs for students at the college; and
             26          (ii) authorize a delivery method for the programs.


             27          (b) The programs shall be in place for the beginning of the 2000 fall semester.
             28          (2) (a) The Legislature reaffirms the State Board of Regents governance of the state system
             29      of higher education.
             30          (b) The board, under its master planning responsibilities in Section 53B-6-101 , shall
             31      review the role and mission of Dixie College in relation to:
             32          (i) the offering of a limited number of baccalaureate programs by the college; and
             33          (ii) other available options for the college to provide baccalaureate programs, including
             34      contracting with a research university to deliver baccalaureate programs at or through the college.
             35          (3) (a) The board shall report its findings, together with recommendations for legislation,
             36      if required, to the Legislature's Education Interim Committee and Higher Education Appropriations
             37      Subcommittee by November 15,1999.
             38          (b) The report shall include:
             39          (i) consideration of changing the name of the college to a name such as "Dixie State
             40      College" to reflect consistency within the system as related to institutional offerings and programs;
             41      and
             42          (ii) (A) the methods of delivery and timing for delivery of baccalaureate programs at the
             43      college, comparing on-campus, instructor delivered programs with other available alternatives and
             44      demonstrating that the recommended delivery methods have cost and quality advantages;
             45          (B) the estimated cost for those programs; and
             46          (C) their impact on other institutions within the system.
             47          (4) (a) The budgetary appropriation for the University Center Program at Dixie College
             48      made to Southern Utah University, including any existing reserve funds as of July 1, 1999, shall
             49      be transferred as follows:
             50          (i) monies for administration costs shall be transferred to Dixie College; and
             51          (ii) monies used for offering baccalaureate programs shall be transferred to the State Board
             52      of Regents for distribution to Dixie College.
             53          (b) Dixie College is authorized to use the monies received from the board under
             54      Subsection (4)(a)(ii) to contract with a university or universities to deliver high demand
             55      baccalaureate programs on the Dixie College campus.
             56          (5) (a) The programs referred to in Subsection (1) shall be funded by the monies referred
             57      to in Subsections (4)(a)(i) and (ii).


             58          (b) A contribution of at least $500,000 from the Dixie College Foundation to be made
             59      during the fiscal year beginning July 1, 1999, shall be used to help fund future baccalaureate
             60      programs to be offered by the college and for name change costs.
             61          Section 2. Name change.
             62          The name of the college shall be changed from Dixie College to Dixie State College,
             63      effective July 1, 2000, unless the State Board of Regents, in consultation with Dixie College's
             64      president and board of trustees, recommends otherwise as a result of the review process and report
             65      required under Section 1.
             66          Section 3. Effective date.
             67          This act takes effect on July 1, 1999.
