5 AN ACT RELATING TO PUBLIC EDUCATION; REQUIRING THE STATE
6 SUPERINTENDENT OF PUBLIC INSTRUCTION TO PREPARE AN ANNUAL REPORT
7 ON THE AMOUNT OF CLASS TIME MISSED IN GRADES 9 THROUGH 12 FOR
8 PARTICIPATION IN HIGH SCHOOL ACTIVITIES; PROVIDING FOR THE
9 DEVELOPMENT AND DISSEMINATION OF ACTIVITY DISCLOSURE STATEMENTS;
10 AND REQUIRING LOCAL SCHOOL BOARDS TO INCLUDE INFORMATION ON THE
11 AMOUNT OF CLASS TIME MISSED IN GRADES 9 THROUGH 12 FOR
12 EXTRACURRICULAR ACTIVITIES IN THEIR ANNUAL SCHOOL DISTRICT REPORTS.
13 This act affects sections of Utah Code Annotated 1953 as follows:
14 AMENDS:

16 53A-3-602, as last amended by Chapter 89, Laws of Utah 1991
17 ENACTS:
18 53A-3-420, Utah Code Annotated 1953
19 Be it enacted by the Legislature of the state of Utah:
20 Section 1. Section 53A-1-301 is amended to read:
21 53A-1-301. Appointment -- Qualifications -- Duties.
22 (1) (a) The State Board of Education shall appoint a superintendent of public instruction,
23 hereinafter called the state superintendent, who is the executive officer of the board and serves at
24 the pleasure of the board.
25 (b) The board shall appoint the state superintendent on the basis of outstanding
26 professional qualifications.
27 (c) The state superintendent shall administer all programs assigned to the State Board of
28 Education in accordance with the policies and the standards established by the board.
29 (2) The superintendent shall perform duties assigned by the board, including the following:
30 (a) investigating all matters pertaining to the public schools;
31 (b) adopting and keeping an official seal to authenticate the superintendent's official acts;
32 copies of authenticated documents shall be received as evidence in the courts of this state in the
33 same manner as originals;
34 (c) holding and conducting meetings, seminars, and conferences on educational topics;
35 (d) presenting to the governor and the Legislature each December a report of the public
36 school system for the preceding year to include:
37 (i) data on the general condition of the schools with recommendations considered desirable
38 for specific programs;
39 (ii) a complete statement of fund balances;
40 (iii) a complete statement of revenues by fund and source;
41 (iv) a complete statement of adjusted expenditures by fund, the status of bonded
42 indebtedness, the cost of new school plants, and school levies;
43 (v) a complete statement of state funds allocated to each of the state's 40 school districts
44 by source, including supplemental appropriations, and a complete statement of expenditures by
45 each district, including supplemental appropriations, by function and object as outlined in the U.S.
46 Department of Education publication Financial Accounting for Local and State School Systems;
47 (vi) a statement that includes such items as fall enrollments, average membership, high
48 school graduates, certificated and classified employees, pupil-teacher ratios, average salaries,
49 applicable private school data, and data from standardized norm-referenced tests in grades 5, 8,
50 and 11 on each school and district;
51 (vii) statistical information regarding incidents of delinquent activity in the schools or at
52 school-related activities with separate categories for:
53 (A) alcohol and drug abuse;
54 (B) weapon possession;
55 (C) assaults; and
56 (D) arson; [
57 (viii) a statement on the amount of class time missed by students and faculty in grades 9
58 through 12 for activities which occur or for which travel is required during normal class time, to
59 include:
60 (A) the total number of individuals involved, the total amount of normal class time missed,
61 the total miles traveled to and from the activities, and the costs for transporting students and
62 faculty to and from the activities; and
63 (B) a breakdown of the totals under Subsection (viii)(A) by individual school district and
64 a breakdown of the activities by category as follows:
65 (I) athletic contests;
66 (II) music performances and contests;
67 (III) forensics, debate, speech, and drama performances and contests;
68 (IV) school club activities and contests; and
69 (V) all other school-sponsored activities and contests; and

71 superintendent considers pertinent; and
72 (e) with the approval of the board, preparing and submitting to the governor a budget for
73 the board to be included in the budget that the governor submits to the Legislature.

91 books, records, documents, maps, reports, papers, and other articles pertaining to his office.
92 Section 2. Section 53A-3-420 is enacted to read:
93 53A-3-420. Activity disclosure statements.
94 (1) A local school board shall require the development of activity disclosure statements
95 for each school-sponsored group, club, or program which involves students and faculty in grades
96 9 through12 in contests, performances, events, or other activities that require them to miss normal
97 class time or takes place outside regular school time.
98 (2) The activity disclosure statements shall be disseminated to the students desiring
99 involvement in the specific activity or to the students' parents or legal guardians or to both students
100 and their parents.
101 (3) An activity disclosure statement shall contain the following information:
102 (a) the specific name of the club, team, group, or activity;
103 (b) the maximum number of students involved;
104 (c) whether or not tryouts are used to select students, specifying date and time
105 requirements for tryouts, if applicable;
106 (d) beginning and ending dates of the activity;
107 (e) a tentative schedule of the events, performances, games, or other activities with dates,
108 times, and places specified if available;
109 (f) if applicable, designation of any nonseason events or activities, including an indication
110 of the status, required, expected, suggested, or optional, with the dates, times, and places specified;
111 (g) personal costs associated with the activity;
112 (h) the name of the school employee responsible for the activity; and
113 (i) any additional information considered important for the students and parents to know.
114 Section 3. Section 53A-3-602 is amended to read:
115 53A-3-602. School district performance report -- Elements -- Annual filing.
116 (1) Each school district shall develop a district performance report providing for
117 accountability of the district to its residents for the quality of schools and the educational
118 achievement of students in the district.
119 (2) The report shall include the following statistical data:
120 (a) norm-referenced achievement test scores and trends by grade or subject;
121 (b) ACT scores, including trend data and the percentage of each graduating class taking
122 the ACT;
123 (c) advanced placement scores, including numbers taking the tests and percentage who
124 pass;
125 (d) criterion-referenced test scores, including trend data;
126 (e) enrollment trends;
127 (f) ethnic distribution of student population;
128 (g) attendance and drop-out rates and trends;
129 (h) fiscal information, including revenues available to the district by source and total and
130 the information required under Subsection 53A-1-301 (2)(d) as related to the district;
131 (i) expenditures by source and total;
132 (j) per pupil expenditures and trends;
133 (k) pupil-teacher ratios and trends;
134 (l) certificated staff by level and average years of professional experience;
135 (m) course-taking patterns and trends in the high schools;
136 (n) number of buildings by level, number of buildings on year-round programs, and
137 number of buildings on extended days;
138 (o) percent of free or reduced school lunch participants;
139 (p) percent of students receiving fee waivers and dollar amount of fee waivers; [
140 (q) percent of AFDC families[
141 (r) a statement on the amount of class time missed by students and faculty in grades 9
142 through 12 for activities which require them to miss normal class time, to include:
143 (i) the total number of individuals involved;
144 (ii) the hours of normal class time missed;
145 (iii) the total miles traveled to and from the activities;
146 (iv) the costs for transporting students and faculty to and from the activities; and
147 (v) a breakdown of the activities by category as follows:
148 (A) athletic contests;
149 (B) music performances and contests;
150 (C) forensics, debate, speech, and drama performances and contests;
151 (D) school club activities and contests; and
152 (E) all other school-sponsored activities and contests.
153 (3) School districts may include any other data in their reports which they feel is important
154 to report to the general public.
155 (4) Each district shall issue its report annually by January 15.
156 (5) Each district shall file a copy of its report with the Legislature and the State Board of
157 Education and have it distributed to the residence of each student enrolled in the district.
