             6      AN ACT RELATING TO PARKS AND RECREATION; AUTHORIZING THE BOARD OF
             7      PARKS AND RECREATION TO APPOINT THE MEMBERS OF THE RIVERWAY
             8      ENHANCEMENT ADVISORY COUNCIL.
             9      This act affects sections of Utah Code Annotated 1953 as follows:
             10      AMENDS:
             11          63-11-17.7, as last amended by Chapter 243, Laws of Utah 1996
             12      Be it enacted by the Legislature of the state of Utah:
             13          Section 1. Section 63-11-17.7 is amended to read:
             14           63-11-17.7. Riverway Enhancement Advisory Council created -- Composition --
             15      Terms -- Vacancies -- Chair -- Quorum -- Council payment.
             16          (1) There is created [in] within the Division of Parks and Recreation [a] the Riverway
             17      Enhancement Advisory Council for the purpose of advising the Division and the Board of Parks
             18      and Recreation regarding the [purposes of this chapter] riverway enhancement program.
             19          (2) The advisory council [is comprised] consists of 11 members appointed by the Board
             20      of Parks and Recreation as follows:
             21          (a) [Seven members who are] One elected municipal [officers] officer shall be [selected
             22      by the governor. The governor shall appoint one member] appointed from each of the following
             23      planning districts:
             24          (i) Bear River - Box Elder, Cache, and Rich Counties;
             25          (ii) Five County - Beaver, Garfield, Iron, Kane, and Washington Counties;
             26          (iii) Mountainland - Summit, Utah, and Wasatch Counties;
             27          (iv) Six County - Juab, Millard, Piute, Sanpete, Sevier, and Wayne Counties;


             28          (v) Southeast - Carbon, Emery, Grand, and San Juan Counties;
             29          (vi) Uintah Basin - Daggett, Duchesne, and Uintah Counties; and
             30          (vii) Wasatch Front - Davis, Morgan, Salt Lake, Tooele, and Weber Counties.
             31          (b) Four members shall be appointed [by the governor] from among the residents of cities
             32      and towns in the state.
             33          (3) (a) Except as required by Subsection (2)(b), each member shall be appointed for a
             34      four-year term of office.
             35          (b) Notwithstanding the requirements of Subsection (3)(a), the [governor] Board of Parks
             36      and Recreation shall, at the time of appointment or reappointment, adjust the length of terms to
             37      ensure that the terms of council members are staggered so that approximately half of the council
             38      is appointed every two years.
             39          (4) (a) Any vacancy occurring in the advisory council shall be filled by a person having
             40      the same qualifications as the person whose office has been vacated.
             41          (b) When a vacancy occurs in the membership for any reason, the replacement shall be
             42      appointed for the unexpired term.
             43          (5) The advisory council shall appoint a chair from its membership, who shall serve for
             44      a term of office of two years but may be reelected for subsequent terms. Six members of the
             45      council constitutes a quorum.
             46          (6) (a) Members shall receive no compensation or benefits for their services, but may
             47      receive per diem and expenses incurred in the performance of the member's official duties at the
             48      rates established by the Division of Finance under Sections 63A-3-106 and 63A-3-107 .
             49          (b) Members may decline to receive per diem and expenses for their service.
