             7      AN ACT RELATING TO RIGHTS-OF-WAY ACROSS FEDERAL LANDS; DIRECTING THE
             8      COLLEGE OF NATURAL RESOURCES AT UTAH STATE UNIVERSITY TO INVENTORY
             9      AND MAP R.S. 2477 RIGHTS-OF-WAY USING GLOBAL POSITIONING SYSTEM
             10      TECHNOLOGY AND TO PHOTOGRAPH ROADS, EVIDENCE OF VALID EXISTING
             11      RIGHTS, AND OTHER STRUCTURES ON FEDERAL LANDS; APPROPRIATING $450,000
             12      FROM THE GENERAL FUND IN FISCAL YEAR 1999-2000 FOR THE WORK; AND
             13      PROVIDING AN EFFECTIVE DATE.
             14      This act affects sections of Utah Code Annotated 1953 as follows:
             15      ENACTS:
             16          72-5-304.5, Utah Code Annotated 1953
             17      Be it enacted by the Legislature of the state of Utah:
             18          Section 1. Section 72-5-304.5 is enacted to read:
             19          72-5-304.5. Inventory and mapping of R.S. 2477 rights-of-way -- Photographing of
             20      roads, structures, and evidence of valid and existing rights on federal lands.
             21          (1) The College of Natural Resources at Utah State University, in coordination with the
             22      Cooperative Extension Service and Utah Association of Counties, shall:
             23          (a) inventory and map R.S. 2477 rights-of way using Global Positioning System (GPS)
             24      technology; and
             25          (b) photograph:
             26          (i) roads and other evidence of construction of R.S. 2477 rights-of-way;
             27          (ii) structures or natural features that may indicate the purpose of an R.S. 2477


             28      right-of-way, such as mines, agricultural facilities, recreational facilities, or scenic overlooks; and
             29          (iii) evidence of valid and existing rights on federal lands, such as mines and agricultural
             30      facilities.
             31          (2) In selecting lands on which to perform the work described in Subsection (1), priority
             32      shall be given to federal lands:
             33          (a) that a federal land management agency proposes for special management, such as lands
             34      to be managed as an area of critical environmental concern or primitive area; or
             35          (b) proposed to receive a special designation by Congress, such as lands to be designated
             36      as wilderness or a national conservation area.
             37          (3) Utah State University and each county in which the work described in Subsection (1)
             38      is performed shall enter into a memorandum of agreement which shall specify:
             39          (a) the scope of work;
             40          (b) a project budget; and
             41          (c) any monetary or in-kind contributions of the county.
             42          (4) To avoid duplication of work and minimize expenses, Utah State University is
             43      encouraged to obtain maps and other relevant data on file with state agencies.
             44          Section 2. Appropriation.
             45          (1) Except as provided in H.B. 4, Appropriations Coordination Act, there is appropriated
             46      $450,000 from the General Fund in fiscal year 1999-2000, to the College of Natural Resources at
             47      Utah State University to inventory and map R.S. 2477 rights-of-way and photograph roads and
             48      other structures as provided by Section 72-5-304.5 .
             49          (2) The money appropriated in Subsection (1) is nonlapsing.
             50          Section 3. Effective date.
             51          This act takes effect on July 1, 1999.
