             6      AN ACT RELATING TO STATE OFFICERS AND EMPLOYEES; REMOVING
             7      CATEGORICAL RESTRICTIONS ON FUNDS APPROPRIATED TO BENEFIT
             8      DEFENSE-RELATED EMPLOYEES AND BUSINESSES.
             9      This act affects sections of Utah Code Annotated 1953 as follows:
             10      AMENDS:
             11          67-1-12, as last amended by Chapter 375, Laws of Utah 1997
             12      Be it enacted by the Legislature of the state of Utah:
             13          Section 1. Section 67-1-12 is amended to read:
             14           67-1-12. Displaced defense workers.
             15          (1) The governor, through the Department of Workforce Services, may use funds
             16      specifically appropriated by the Legislature to benefit, in a manner prescribed by Subsection (2):
             17          (a) Department of Defense employees within the state who lose their employment because
             18      of reductions in defense spending by the federal government;
             19          (b) persons dismissed by a defense-related industry employer because of reductions in
             20      federal government defense contracts received by the employer; and
             21          (c) defense-related businesses in the state that have been severely and adversely impacted
             22      because of reductions in defense spending.
             23          (2) [For funds previously] Funds appropriated under this section before fiscal year
             24      1999-2000 but not expended [as of the fiscal year 1995-96 and for all subsequent appropriations,
             25      at least 40% of any amount appropriated under this section shall be administered through the
             26      Division of Employment Development and shall be used to fund actual job training services] shall
             27      remain with the agency that possesses the funds and shall be used in a manner consistent with this


             28      section. [Sixty percent of any] Any amount appropriated under this section in fiscal year
             29      1999-2000 or thereafter may be used to:
             30          (a) provide matching or enhancement funds for grants, loans, or other assistance received
             31      by the state from the United States Department of Labor, Department of Defense, or other federal
             32      agency to assist in retraining, community assistance, or technology transfer activities;
             33          (b) fund or match available private or public funds from the state or local level to be used
             34      for retraining, community assistance, technology transfer, or educational projects coordinated by
             35      state or federal agencies;
             36          (c) provide for retraining, upgraded services, and programs at applied technology centers,
             37      public schools, higher education institutions, or any other appropriate public or private entity that
             38      are designed to teach specific job skills requested by a private employer in the state or required for
             39      occupations that are in demand in the state;
             40          (d) aid public or private entities that provide assistance in locating new employment;
             41          (e) inform the public of assistance programs available for persons who have lost their
             42      employment;
             43          (f) increase funding for assistance and retraining programs;
             44          (g) provide assistance for small start-up companies owned or operated by persons who
             45      have lost their employment;
             46          (h) enhance the implementation of dual-use technologies programs, community adjustment
             47      assistance programs, or other relevant programs under Pub. L. No. 102-484; and
             48          (i) coordinate local and national resources to protect and enhance current Utah defense
             49      installations and related operations and to facilitate conversion or enhancement efforts by:
             50          (i) creating and operating state information clearinghouse operations that monitor relevant
             51      activities on the federal, state, and local level;
             52          (ii) identifying, seeking, and matching funds from federal and other public agencies and
             53      private donors;
             54          (iii) identifying and coordinating needs in different geographic areas;
             55          (iv) coordinating training and retraining centers;
             56          (v) coordinating technology transfer efforts between public entities, private entities, and
             57      institutions of higher education;
             58          (vi) facilitating the development of local and national awareness and support for Utah


             59      defense installations;
             60          (vii) studying the creation of strategic alliances, tax incentives, and relocation and
             61      consolidation assistance; and
             62          (viii) exploring feasible alternative uses for the physical and human resources at defense
             63      installations and in related industries should reductions in mission occur.
             64          (3) The governor, through the Department of Workforce Services, may coordinate and
             65      administer the expenditure of monies under this section and collaborate with applied technology
             66      centers, public institutions of higher learning, or other appropriate public or private entities to
             67      provide retraining and other services described in Subsection (2).
