7 AN ACT RELATING TO NURSE EDUCATION FINANCIAL ASSISTANCE; LIMITING THE
8 USE OF APPROPRIATIONS; AND PROVIDING AN EFFECTIVE DATE.
9 This act affects sections of Utah Code Annotated 1953 as follows:
10 AMENDS:
11 26-9d-9, as enacted by Chapter 252, Laws of Utah 1992
12 Be it enacted by the Legislature of the state of Utah:
13 Section 1. Section 26-9d-9 is amended to read:
14 26-9d-9. Funding.
15 (1) The funding provided for the scholarship and grant programs shall be a separate line
16 item to the department in the annual appropriations act, and unless otherwise provided in an
17 appropriations act, is nonlapsing. This funding shall include:
18 (a) appropriations from the General Fund;
19 (b) damages collected from breach of the scholarship and loan repayment program
20 contracts; and
21 (c) federal funds, gifts, endowments, and contributions for the programs.
22 (2) After a scholarship or loan repayment program contract has been signed by both
23 parties, the committee shall set aside the funds necessary to ensure that sufficient funds will be
24 available to make payments under a scholarship or loan repayment program contract for the full
25 term of obligated service.
26 (3) Funding under Subsection (1) shall be used to make payments under the scholarship
27 or loan repayment program contracts [
28 (4) Committee and department staff support costs necessary to administer this chapter shall
29 be appropriated by the Legislature.
30 Section 2. Effective date.
31 This act takes effect on July 1, 1999.
