             7      AN ACT RELATING TO NURSE EDUCATION FINANCIAL ASSISTANCE; LIMITING THE
             8      USE OF APPROPRIATIONS; AND PROVIDING AN EFFECTIVE DATE.
             9      This act affects sections of Utah Code Annotated 1953 as follows:
             10      AMENDS:
             11          26-9d-9, as enacted by Chapter 252, Laws of Utah 1992
             12      This act enacts uncodified material.
             13      Be it enacted by the Legislature of the state of Utah:
             14          Section 1. Section 26-9d-9 is amended to read:
             15           26-9d-9. Funding.
             16          (1) The funding provided for the scholarship and grant programs shall be a separate line
             17      item to the department in the annual appropriations act, and unless otherwise provided in an
             18      appropriations act, is nonlapsing. This funding shall include:
             19          (a) appropriations from the General Fund;
             20          (b) damages collected from breach of the scholarship and loan repayment program
             21      contracts; and
             22          (c) federal funds, gifts, endowments, and contributions for the programs.
             23          (2) After a scholarship or loan repayment program contract has been signed by both
             24      parties, the committee shall set aside the funds necessary to ensure that sufficient funds will be
             25      available to make payments under a scholarship or loan repayment program contract for the full


             26      term of obligated service.
             27          (3) Funding under Subsection (1) shall be used to make payments under the scholarship
             28      or loan repayment program contracts [and cover costs as provided in Subsection (4)].
             29          (4) Committee and department staff support costs necessary to administer this chapter shall
             30      be appropriated by the Legislature.
             31          Section 2. Transition to separate appropriations.
             32          (1) Unless otherwise appropriated by the Legislature, the amount appropriated for
             33      scholarships and grants in the Nurse Education Financial Assistance Program under Subsection
             34      26-9d-9 (1) for fiscal year 2000-01 may not exceed the total amount appropriated for the Nurse
             35      Education Financial Assistance Program for fiscal year 1999-2000 minus the amount expended
             36      by the Department of Health for committee and department staff support for the Nurse Education
             37      Financial Assistance Program during fiscal year 1999-2000.
             38          (2) Unless otherwise appropriated by the Legislature, the amount appropriated for
             39      committee and department staff support for the Nurse Education Financial Assistance Program
             40      under Subsection 26-9d-9 (4) for fiscal year 2000-01 may not exceed the amount expended by the
             41      Department of Health for committee and department staff support for the Nurse Education
             42      Financial Assistance Program during fiscal year 1999-2000.
             43          Section 3. Effective date.
             44          This act takes effect on May 3, 1999, except that Section 26-9d-9 takes effect on July 1,
             45      2000.
