             6      AN ACT RELATING TO MILITIAS AND ARMORIES; PROVIDING THAT ANY MONIES
             7      APPROPRIATED TO THE NATIONAL GUARD FOR TUITION ASSISTANCE IS TO BE
             8      NONLAPSING.
             9      This act affects sections of Utah Code Annotated 1953 as follows:
             10      AMENDS:
             11          39-1-63, as last amended by Chapter 233, Laws of Utah 1998
             12      Be it enacted by the Legislature of the state of Utah:
             13          Section 1. Section 39-1-63 is amended to read:
             14           39-1-63. Tuition assistance for National Guard members -- Use and allocation --
             15      Appropriation.
             16          (1) The Utah National Guard may provide tuition assistance to members for study at
             17      postsecondary institutions of learning, including Applied Technology Centers, subject to the
             18      following requirements:
             19          (a) The individual must be, at the time he or she receives the assistance, an active member
             20      of the Utah National Guard.
             21          (b) The assistance is for tuition only and shall be not more than the resident tuition for the
             22      actual course of postsecondary study engaged in by the individual.
             23          (2) Tuition assistance shall be awarded for each academic year. Students may apply to the
             24      adjutant general for assistance for each year during which he or she is an active member of the
             25      Utah National Guard. In awarding assistance, the adjutant general shall consider the recruitment
             26      and retention needs of the National Guard.
             27          (3) Tuition assistance is to be paid by the adjutant general of the state directly to the


             28      institutions involved from the funds appropriated.
             29          (4) The adjutant general of the state shall establish regulations, procedures, forms, and
             30      reports necessary to administer the allocation of assistance and payment of funds under this
             31      section.
             32          (5) The adjutant general shall include a request each year for funds for this program in the
             33      annual budget for the National Guard.
             34          (6) A person who transfers from the Select Reserve to the National Guard is not eligible
             35      for the tuition assistance in this section for one year from the date of transfer.
             36          (7) Any monies appropriated by the Legislature to implement this section shall be
             37      nonlapsing.
