Second Substitute S.B. 135

Senator Scott N. Howell proposes to substitute the following bill:

             5      AN ACT RELATING TO THE MOTOR VEHICLE ACT; PROVIDING THAT VEHICLES
             6      TITLED AND LICENSED TO THE SALT LAKE ORGANIZING COMMITTEE MAY
             7      RECEIVE OLYMPIC LICENSE PLATES BY PAYING ONLY ADMINISTRATIVE COSTS;
             8      AND PROVIDING AN EFFECTIVE DATE.
             9      This act affects sections of Utah Code Annotated 1953 as follows:
             10      AMENDS:
             11          41-1a-407, as renumbered and amended by Chapter 1, Laws of Utah 1992
             12          41-1a-417, as enacted by Chapter 173, Laws of Utah 1996
             13          41-1a-1211, as last amended by Chapters 157, 184 and 352, Laws of Utah 1998
             14      Be it enacted by the Legislature of the state of Utah:
             15          Section 1. Section 41-1a-407 is amended to read:
             16           41-1a-407. Plates issued to political subdivisions or state -- Use of "EX" letters --
             17      Confidential information.
             18          (1) Except as provided in Subsection (2), each town, city, board of education, school
             19      district, state institution of learning, county, other governmental division, subdivision, or district,
             20      and the state shall:
             21          (a) place a license plate displaying the letters, "EX" on every vehicle owned and operated
             22      by it or leased for its exclusive use; and
             23          (b) display an identification mark designating the vehicle as the property of the entity in
             24      a conspicuous place on both sides of the vehicle.
             25          (2) The entity need not display the "EX" license plate or the identification mark required


             26      by Subsection (1) if:
             27          (a) the vehicle is in the direct service of the governor, lieutenant governor, attorney
             28      general, state auditor, or state treasurer of Utah;
             29          (b) the vehicle is used in official investigative work where secrecy is essential;
             30          (c) the vehicle is provided to an official of the entity as part of a compensation package
             31      allowing unlimited personal use of that vehicle; or
             32          (d) the personal security of the occupants of the vehicle would be jeopardized if the "EX"
             33      license plate were in place.
             34          (3) Plates issued to Utah Highway Patrol vehicles may bear the capital letters "UHP," a
             35      beehive logo, and the call number of the vehicle for which the plate is issued.
             36          (4) The commission shall issue "EX" and "UHP" plates and shall make rules establishing
             37      the procedure for application for and distribution of the plates.
             38          (5) (a) Information shall be confidential for vehicles that are not required to display the
             39      "EX" license plate or the identification mark under Subsections (2) (a), (b), and (d).
             40          (b) (i) If a law enforcement officer's identity must be kept secret, his agency head may
             41      request in writing that the division remove the license plate information of the officer's personal
             42      vehicles from all public access files and place it in a confidential file until the assignment is
             43      completed.
             44          (ii) The agency head shall notify the division when the assignment is completed.
             45          (6) Each town, city, county, other governmental division, subdivision, district, or the state
             46      may choose to have the Olympic license plate as the official license plate for its publicly-owned
             47      vehicles. As of July 1, 1999, whenever a license is issued or renewed for one of those vehicles,
             48      an Olympic license plate may be issued for that vehicle upon a one-time payment to the State Tax
             49      Commission of the production and administrative costs described in Subsection 41-1a-417 (2).
             50      Those vehicles are, however, exempt from the additional special fee described in Section
             51      41-1a-417 , and from payment of the renewal fee described in Section 41-1a-1211 .
             52          Section 2. Section 41-1a-417 is amended to read:
             53           41-1a-417. Olympic license plates -- Fees -- Design.
             54          (1) (a) Beginning no sooner than January 1, 1997, any person who is the owner or lessee
             55      of a motor vehicle as defined under Section 41-1a-102 may apply for Olympic license plates
             56      through June 30, 2002.


             57          (b) [In] Except as provided in Subsection (5), in addition to the regular motor vehicle
             58      registration fees, the applicant shall pay a special fee of $22.00 at the time the Olympic license
             59      plates are issued.
             60          (2) (a) The State Tax Commission shall at least monthly deposit revenues from the special
             61      fees collected under Subsection (1), less production and administrative costs as provided in this
             62      subsection, to the Salt Lake Olympic Organizing Committee's "Olympics for Youth and Children
             63      Account."
             64          (b) The special fees paid for purchase or renewal of Olympic license plates shall be treated
             65      as a voluntary contribution and is not a motor vehicle registration fee.
             66          (c) Before depositing revenues into the Salt Lake Olympic Organizing Committee's
             67      account, the State Tax Commission shall deduct the actual production and administrative costs
             68      associated with making and issuing the Olympic license plates.
             69          (3) The Salt Lake Olympic Organizing Committee shall approve the color and design of
             70      the Olympic license plates consistent with the provisions of Sections 41-1a-401 , 41-1a-402 , and
             71      41-1a-403 and with the concurrence of the State Tax Commission and the Utah Highway Patrol.
             72          (4) Any person who applies for Olympic license plates may also apply for personalized
             73      numbers or letters on the Olympic license plates as authorized by Section 41-1a-410 and after
             74      payment of the fees required by Section 41-1a-1211 .
             75          (5) Vehicles that are leased by or titled and licensed under the name of the Salt Lake
             76      Olympic Organizing Committee shall receive Olympic license plates upon payment of only the
             77      production and administrative costs described in Subsection (2). Those vehicles are also exempt
             78      from payment of the renewal fee described in Section 41-1a-1211 .
             79          (6) As of July 1, 1999, each local political subdivision and the state may choose to have
             80      the Olympic license plate as the official license plate for its publicly-owned vehicles, pursuant to
             81      the provisions of Subsection 41-1a-407 (6). Neither the special fee described in Subsection (1)(b)
             82      nor the renewal fee described in Section 41-1a-1211 applies to those vehicles.
             83          Section 3. Section 41-1a-1211 is amended to read:
             84           41-1a-1211. License plate fees -- Application fees for issuance and renewal of
             85      personalized and special group license plates -- Replacement fee for license plates -- Postage
             86      fees.
             87          (1) A license plate fee of $5 per set shall be paid to the division for the issuance of any new


             88      license plate under Part 4, License Plates and Registration Indicia, except for license plates issued
             89      under Sections 41-1a-407 and 41-1a-417 . The license plate fee shall be deposited as follows:
             90          (a) $4 as provided in Section 41-1a-1201 ; and
             91          (b) $1 in the Transportation Fund.
             92          (2) An applicant for original issuance of personalized license plates issued under Section
             93      41-1a-410 shall pay a $50 per set license plate application fee in addition to the fee required in
             94      Subsection (1).
             95          (3) (a) Except as provided in Subsections (3)(b) and (3)(c), applicants for original issuance
             96      of special group license plates issued under Section 41-1a-408 shall pay a $50 per set license plate
             97      application fee in addition to the fee required under Subsection (1).
             98          (b) A person who qualifies for a licensed amateur radio operator special group license plate
             99      shall pay a $5 fee for the original set of license plates in addition to the fee required under
             100      Subsection (1).
             101          (c) A person who qualifies for legislative, United States Congressional, person with a
             102      disability, collegiate, veterans', wildlife, National Guard, Purple Heart, Prisoner of War, Survivor
             103      of the Japanese Attack on Pearl Harbor, firefighter, children's issues, snowmobile, soil
             104      conservation, or farm vehicle special group license plates is exempt from payment of special group
             105      license plate application fees imposed under this Subsection (3)(c).
             106          (4) An applicant for original issuance of personalized special group license plates shall pay
             107      the license plate application fees required in Subsection (2) in addition to the license plate fees and
             108      license plate application fees established under Subsections (1) and (3).
             109          (5) The following application fees for renewal of personalized and special group license
             110      plates shall be paid to the division at the time of renewal of registration:
             111          (a) an applicant for renewal of personalized license plates issued under Section 41-1a-410
             112      shall pay a $10 per set application fee;
             113          (b) except as provided in Subsection (5)(c), an applicant for renewal of special group
             114      license plates issued under Section 41-1a-408 shall pay a $10 per set application fee; and
             115          (c) an applicant for renewal of legislative, United States Congressional, person with a
             116      disability, collegiate, wildlife, National Guard, Purple Heart, Prisoner of War, Survivor of the
             117      Japanese Attack on Pearl Harbor, farm vehicle, vintage vehicle, firefighter, children's issues,
             118      snowmobile, soil conservation, or licensed amateur radio operator special group license plates is


             119      exempt from payment of application fees imposed under this subsection.
             120          (6) An applicant for renewal of personalized special group license plates shall pay the
             121      application fee required in Subsection (5)(a) in addition to the applicable application fees for
             122      renewal of license plates established under Subsections (5)(b) and (5)(c).
             123          (7) A fee of $5 shall be paid to the division for the replacement of any license plate issued
             124      under Part 4, License Plates and Registration Indicia. The license plate fee shall be deposited as
             125      follows:
             126          (a) $4 as provided in Section 41-1a-1201 ; and
             127          (b) $1 in the Transportation Fund.
             128          (8) The division may charge a fee established under Section 63-38-3.2 to recover its costs
             129      for the replacement of decals issued under Section 41-1a-408 .
             130          (9) The division may charge a fee established under Section 63-38-3.2 to recover the cost
             131      of issuing stickers under Section 41-1a-416 .
             132          (10) In addition to any other fees required by this section, the division shall assess a fee
             133      established under Section 63-38-3.2 to cover postage expenses if new or replacement license plates
             134      are mailed to the applicant.
             135          (11) The fees required under this section are separate from and in addition to registration
             136      fees required under Section 41-1a-1206 .
             137          (12) [For] Except as otherwise provided in Sections 41-1a-407 and 41-1a-417 , vehicles
             138      with registration years expiring on or before June 30, 2002, applicants for original Olympic special
             139      group license plates or renewal of registration with Olympic special group license plates shall pay
             140      the fees required under Section 41-1a-417 .
             141          Section 4. Effective date.
             142          This act takes effect on July 1, 1999.
