Rep. Chard, Co-Chair, called the meeting to order at 2:10 p.m.

MOTION:    Rep. Cox moved to approve the minutes of the February 8, 1999 meeting. The motion passed unanimously with Rep. Swallow absent for the vote.

    Jan Graham, Attorney General, responded in regard to the previous vote to remove an additional 2 % from the Attorney General's Office. She explained to the committee how they would be effected by the 2% cut.

MOTION:    Sen. Waddoups moved to invite the Attorney General to the Monday Feb 15th meeting to conclude her response on the 2% cut. The motion passed unanimously.

    Paul Ashton, Executive Director of Petroleum Retailers Organization, presented his concern about the below cost selling of fuel in Chapter 16, Motor Fuel Marketing, not being enforced. The subcommittee members received a handout illustrating the problem.

    Charlene Barlow, Division Chief of the Consumer Rights Division, responded to Paul Ashton's concerns.

    David Salisbury, President of Sutherland Institute; Marvin Weeby, Senior Vice President of Development Cornell Corrections; and Michael Murhpy, Director of Marketing Management Training Corporation addressed the subcommittee regarding privatizing the community correctional facilities. The subcommittee received the following handouts: The Value of Treatment in Prison and Private Prisons: Quality Corrections at a Lower Cost.

    

    Layne Meacham addressed the committee about Youth Corrections issues, the subcommittee received the following handout: Youth Corrections Issues (should be answered before millions approved).

MOTION:    Rep. Bigelow moved to saunter. The motion passed unanimously and the subcommittee reconvened at 3:25 p.m.

MOTION:    Rep. Zolman moved that the committee proceed to the next item of business.

SUBSTITUTE MOTION:    Rep. Swallow moved to approve the Analyst recommendation for the Courts budget minus the 1% set aside for a total of $90,119,500. The motion passed with Rep. Zolman voting in opposition and Rep. Bryson absent for the vote.

MOTION:    Rep. Zolman moved to fund the Utah Board of Pardons and Parole at $2,544,900 broken down as follows:

    GENERAL FUND        $ 2,397,800

        ' 99 level        2,323,300
        Dedicated Credits     8,000
        New FTE         66,500

    The motion passed with Reps. Bigelow, Swallow, and Sen. Waddoups voting in opposition and Rep. Bryson absent for the vote.

MOTION:    Rep. Cox moved the following intent language.

        It is the intent of the Legislature that during 1999, the Department of Human Resource Management conduct a study comparing correctional officer compensation with the market, for review during the 2000 Legislative session.

        The motion passed unanimously.

MOTION:    Rep. Zolman moved to approve the analyst recommendation for the Department of Corrections without the 1% set aside for a total of $177,903,000. The motion passed unanimously.





MOTION:    Sen. Suazo moved the following intent language.

        It is the intent of the Legislature to direct the Department of Corrections to proceed immediately in building minimum security housing using funds from the Violent Offender Incarceration Truth in Sentencing (VOITIS) Act.

        The motion passed unanimously.

    Mr. Haun, Executive Director of the Department of Corrections spoke in favor of the motion.

MOTION:    Rep. Bryson moved to add $59,400 to the Capitol Litigation Clerk for the Courts.
        The motion was withdrawn.

    Analyst Bill Dinehart gave each member of the subcommittee a copy of the intent language for Capitol Facilities and proposed the budget for the Department of Public Safety. The Analyst recommends a total budget of $87,124,900.

    Dave Walsh, UCCJJ, answered questions from the committee regarding public safety.

    The subcommittee received a written response from Ray Wahl, Juvenile Court Administration, regarding the Legislative Audit.

    More information was requested from the committee on Comprehensive Emergency Management Agency federal dollars and more detail was requested on the Motor Pool intent language.

MOTION:    Rep. Zolman moved that the subcommittee be adjourned. The motion passed unanimously with Reps. Bryson, Swallow, and Sen. Suazo absent for the vote.

Co-Chair Rep. Chard adjourned the meeting at 5:03
