             6      AN ACT RELATING TO PUBLIC EDUCATION; CREATING THE FUNDING OF PUBLIC
             7      EDUCATION TASK FORCE; PROVIDING FOR MEMBERSHIP; PROVIDING DUTIES AND
             8      REQUIRING AN INTERIM REPORT; APPROPRIATING $37,000 FOR FISCAL YEAR
             9      1999-2000; PROVIDING AN EFFECTIVE DATE; AND PROVIDING A REPEAL DATE.
             10      This act enacts uncodified material.
             11      Be it enacted by the Legislature of the state of Utah:
             12          Section 1. Funding of Public Education Task Force -- Creation -- Membership --
             13      Quorum -- Staff.
             14          (1) There is created the Funding of Public Education Task Force consisting of the
             15      following members:
             16          (a) three members of the Senate appointed by the president of the Senate, no more than
             17      two of whom may be from the same political party; and
             18          (b) five members of the House of Representatives appointed by the speaker of the House
             19      of Representatives, no more than three of whom may be from the same political party.
             20          (2) (a) The president of the Senate shall designate a member of the Senate appointed under
             21      Subsection (1)(a) as a cochair of the task force.
             22          (b) The speaker of the House of Representatives shall designate a member of the House
             23      of Representatives appointed under Subsection (1)(b) as a cochair of the task force.
             24          (3) In conducting its business, the task force shall comply with the rules of the legislative
             25      interim committees.
             26          (4) Members of the task force shall receive compensation and expenses in accordance with
             27      Section 36-2-2 and Legislative Joint Rule 15.03.


             28          (5) The Office of Legislative Research and General Counsel shall provide staff support to
             29      the task force.
             30          Section 2. Duties of the task force.
             31          (1) The task force shall review and make recommendations on the following issues:
             32          (a) current state and local practices regarding the funding of the state's public education
             33      system, including designated revenue sources and funding formulas such as voted and board
             34      leeways, school fees, the capital outlay foundation program, and the funding formulas for at-risk
             35      and special education student populations;
             36          (b) those conditions and tools that enable schools to provide each student a reasonable
             37      opportunity to achieve expected educational goals or objectives;
             38          (c) current school spending practices;
             39          (d) equity and adequacy in funding public education;
             40          (e) alternative revenue sources for funding public education; h [ and ]
             40a           (f) PROVIDING FOR A LONG-TERM PLAN TO INCREASE PUBLIC EDUCATION FUNDING;
             40b      AND h
             41           h [ (f) ] (g) h other issues related to the funding of public education as identified by the task
             41a      force.
             41b          h (2) THE TASK FORCE SHALL NOTIFY AND SEEK INPUT FROM THE STATE BOARD OF
             41c      EDUCATION, THE UTAH SCHOOL BOARDS ASSOCIATION, THE UTAH SCHOOL SUPERINTENDENTS
             41d      ASSOCIATION, THE UTAH PARENTS AND TEACHERS ASSOCIATION, THE UTAH PUBLIC
             41e      EDUCATION COALITION, THE UTAH EDUCATION ASSOCIATION, AND OTHER MEMBERS OF THE
             41f      STATE'S PUBLIC EDUCATION COMMUNITY. h
             42           h [ (2) ] (3) h A final report, including any proposed legislation shall be made to the Education
             43      Interim Committee before November 30, 2000.
             44          Section 3. Appropriation.
             45          There is appropriated from the General Fund for fiscal year 1999-2000:
             46          (1) $4,500 to the Senate to pay for the compensation and expenses of senators on the task
             47      force;
             48          (2) $7,500 to the House of Representatives to pay for the compensation and expenses of
             49      representatives on the task force; and
             50          (3) $25,000 to the Office of Legislative Research and General Counsel to pay for staffing
             51      the task force.
             52          Section 4. Effective date.
             53          If approved by two-thirds of all the members elected to each house, this act takes effect


             54      upon approval by the governor, or the day following the constitutional time limit of Utah
             55      Constitution Article VII, Section 8, without the governor's signature, or in the case of a veto, the
             56      date of veto override.
             57          Section 5. Repeal date.
             58          This act is repealed November 30, 2000.
