             5      AN ACT RELATING TO PUBLIC EDUCATION; REQUIRING THE STRATEGIC PLANNING
             6      FOR PUBLIC AND HIGHER EDUCATION COMMITTEE TO REVIEW AND MAKE
             7      RECOMMENDATIONS ON THE FINANCING OF PUBLIC EDUCATION WITHIN THE
             8      STATE; PROVIDING AN EFFECTIVE DATE; AND PROVIDING A REPEAL DATE.
             9      This act enacts uncodified material.
             10      Be it enacted by the Legislature of the state of Utah:
             11          Section 1. Strategic planning study on financing of public education -- Interim report.
             12          (1) Consistent with its duties and responsibilities outlined in Section 53A-1a-202 , the
             13      Strategic Planning for Public and Higher Education Committee shall, during the 2000 interim,
             14      study, review, and make recommendations to the Legislature on the following issues:
             15          (a) current federal, state, and local revenue sources and funding formulas used for the state
             16      system of public education, to include the value and adequacy of the weighted pupil unit, voted
             17      and board leeways, and capital outlay and debt service and their relationship in funding public
             18      education;
             19          (b) school spending practices, including whether there is a need for more flexibility at the
             20      district and school level;
             21          (c) the relationship between equity and adequacy in funding public education;
             22          (d) the use of student fees by school districts to help fund public education at the district
             23      and school level including the impact of current fee waiver provisions; and
             24          (e) other issues related to funding public education.
             25          (2) (a) If needed, the committee may:
             26          (i) create a subcommittee to more effectively review the issues listed in Subsection (1);
             27      and


             28          (ii) schedule additional meetings to adequately address the financial issues during the 2000
             29      interim as an exception to Subsection 53A-1a-202 (4).
             30          (b) The committee or its subcommittee may arrange to hold joint meetings with other
             31      public entities, such as the Education Interim Committee or Public Education Appropriations
             32      Subcommittee, in its study of these financial issues.
             33          (c) The committee may invite noncommittee members to serve on its subcommittee if it
             34      decides to create one.
             35          (3) The committee shall present a final report, including any proposed legislation to the
             36      Education Interim Committee and Executive Appropriations Committee before November 30,
             37      2000.
             38          Section 2. Effective date.
             39          If approved by two-thirds of all the members elected to each house, this act takes effect
             40      upon approval by the governor, or the day following the constitutional time limit of Utah
             41      Constitution Article VII, Section 8, without the governor's signature, or in the case of a veto, the
             42      date of veto override.
             43          Section 3. Repeal date.
             44          This act is repealed November 30, 2000.
