6 AN ACT RELATING TO PUBLIC EDUCATION; REQUIRING THE STATE BOARD OF
7 EDUCATION, IN COOPERATION WITH THE STATE RISK MANAGER AND THE
8 ATTORNEY GENERAL'S OFFICE, TO DESIGN AND IMPLEMENT A PROFESSIONAL
9 DEVELOPMENT PROGRAM FOR EDUCATORS ON POTENTIAL LIABILITIES THEY
10 FACE IN THEIR EMPLOYMENT; PROVIDING A REVENUE SOURCE TO FUND THE
11 PROGRAM; AND PROVIDING AN EFFECTIVE DATE.
12 This act affects sections of Utah Code Annotated 1953 as follows:
13 ENACTS:
14 53A-1-301.5, Utah Code Annotated 1953
15 Be it enacted by the Legislature of the state of Utah:
16 Section 1. Section 53A-1-301.5 is enacted to read:
17 53A-1-301.5. Design and implementation of educator professional development
18 program.
19 (1) The State Board of Education, through the state superintendent of public instruction,
20 and in cooperation with the State Risk Manager and the Attorney General's Office, shall design and
21 implement an educator professional development program that includes the following components:
22 (a) the potential liabilities faced by educators in their employment setting and what can
23 be done to limit those potential liabilities;
24 (b) the enforcement of school safety and student discipline laws and policies; and
25 (c) services that are available to educators from the State Risk Manager.
26 (2) The state superintendent shall work with local school boards and local superintendents
27 to coordinate the professional development program referred to in Subsection (1) with professional
28 development programs provided at the school district or school level.
29 (3) (a) The Legislature shall provide an annual appropriation to the State Board of
30 Education to help fund the professional development program authorized under this section.
31 (b) The board shall closely monitor the program and make an annual report to the
32 Legislature through the Education Interim Committee on the effectiveness of the program.
33 Section 2. Effective date.
34 This act takes effect on July 1, 2000.
