             6      A JOINT RESOLUTION OF THE LEGISLATURE PROPOSING TO AMEND THE UTAH
             7      CONSTITUTION; CHANGING THE APPOINTING AUTHORITY OF THE STATE
             8      SUPERINTENDENT OF PUBLIC INSTRUCTION; PROVIDING FOR THE POWERS AND
             9      FUNCTIONS OF THE STATE SUPERINTENDENT; DIRECTING THE LIEUTENANT
             10      GOVERNOR TO SUBMIT THE PROPOSAL TO THE VOTERS; AND PROVIDING AN
             11      EFFECTIVE DATE.
             12      This resolution proposes to change the Utah Constitution as follows:
             13      AMENDS:
             14          ARTICLE X, SECTION 3
             15      Be it resolved by the Legislature of the state of Utah, two-thirds of all members elected to each of
             16      the two houses voting in favor thereof:
             17          Section 1. It is proposed to amend Utah Constitution Article X, Section 3 , to read:
             18           Article X, Section 3. [State Board of Education.]
             19          The general control and supervision of the public education system shall be vested in a
             20      State Board of Education. The membership of the board shall be established and elected as
             21      provided by statute. The [State Board of Education] Governor shall appoint a State Superintendent
             22      of Public Instruction who shall be the executive officer of the board and shall exercise the powers
             23      and perform the functions that are provided by statute.
             24          Section 2. Submittal to voters.
             25          The lieutenant governor is directed to submit this proposed amendment to the voters of the
             26      state at the next regular general election in the manner provided by law.
             27          Section 3. Effective date.


             28          If the amendment proposed by this joint resolution is approved by a majority of those
             29      voting on it at the next regular general election, the amendment shall take effect on January 1,
             30      2001.
