7 A JOINT RESOLUTION OF THE LEGISLATURE URGING THE GOVERNOR'S COUNCIL
8 ON DRIVING UNDER THE INFLUENCE TO STUDY AND PREPARE CHANGES TO
9 EXISTING LAW TO STRENGTHEN TRAINING IN THE RESPONSIBLE SERVICE OF
10 ALCOHOLIC BEVERAGES FOR THOSE WORKING IN ESTABLISHMENTS LICENSED TO
11 SERVE ALCOHOLIC BEVERAGES.
12 Be it resolved by the Legislature of the state of Utah:
13 WHEREAS, the primary role of government is to protect the health, safety, and welfare
14 of citizens;
15 WHEREAS, driving under the influence of alcohol and other drugs is a major cause of
16 violence in Utah's highways;
17 WHEREAS, driving under the influence of alcohol and other drugs is a cause of
18 preventable deaths and injuries to Utah citizens;
19 WHEREAS, the cost of driving under the influence of alcohol and other drugs to Utah's
20 taxpayers and to victims is in excess of $413 million annually;
21 WHEREAS, more effective policies and programs to deal with issues related to driving
22 under the influence of alcohol and other drugs are being developed by the Governor's Council on
23 Driving Under the Influence;
24 WHEREAS, citizens are benefitting from the proactive approach of the Governor's Council
25 on Driving Under the Influence to prevent deaths, injuries, and costs associated with driving under
26 the influence of alcohol and other drugs;
27 WHEREAS, a key component of any plan to curb the violence and loss of life due to
28 driving under the influence is improved training in the responsible serving of alcoholic beverages
29 in establishments licensed to serve alcohol;
30 WHEREAS, existing laws governing training should be strengthened to require more
31 timely training of persons serving alcohol, clarify penalties for noncompliance, specify the range
32 of training subjects, provide certification requirements for those conducting the training, and
33 require sharing of records among state agencies responsible for licensing, enforcement, and
34 training;
35 WHEREAS, through improved training and enforcement, the devastating effects of driving
36 under the influence of alcohol and other drugs can be significantly decreased; and
37 WHEREAS, changes intended to strengthen training in the responsible service of alcoholic
38 beverages will reduce the number of tragedies resulting from driving under the influence:
39 NOW, THEREFORE, BE IT RESOLVED that the Legislature of the state of Utah urges
40 the Governor's Council on Driving Under the Influence to study ways to strengthen existing law
41 governing training in the responsible service of alcoholic beverages by persons in establishments
42 licensed to serve alcoholic beverages.
43 BE IT FURTHER RESOLVED that proposals for changes in the law be presented to the
44 Business, Labor, and Economic Development Interim Committee of the Legislature by no later
45 than its November 2000 meeting.
46 BE IT FURTHER RESOLVED that a copy of this resolution be sent to the Governor's
47 Council on Driving Under the Influence, the Division of Substance Abuse, the Alcoholic Beverage
48 Control Commission, and the chairs of the Business, Labor, and Economic Development Interim
49 Committee of the Legislature.
