First Substitute S.B. 19

Senator R. Mont Evans proposes to substitute the following bill:

SURVIVOR BENEFIT OF EMPLOYEES

2000 GENERAL SESSION

             5      AN ACT RELATING TO RETIREMENT; AMENDING INSURANCE BENEFIT PROVISIONS
             6      FOR CERTAIN EMPLOYEES' SURVIVORS.
             7      This act affects sections of Utah Code Annotated 1953 as follows:
             8      AMENDS:
             9          49-8-405, as last amended by Chapter 282, Laws of Utah 1998
             10      Be it enacted by the Legislature of the state of Utah:
             11          Section 1. Section 49-8-405 is amended to read:
             12           49-8-405. Insurance benefits for employees' beneficiaries.
             13          (1) As used in this section:
             14          (a) "Children" includes stepchildren and legally adopted children.
             15          (b) "Line of duty death" means a death resulting from external force or violence
             16      occasioned by an act of duty as an employee.
             17          [(1)] (2) The beneficiary of [a peace officer under Title 53, Chapter 13, Peace Officer
             18      Classifications,] an employee who is employed by the state and who dies in the line of duty [as
             19      defined under Subsection (3),] shall receive:
             20          (a) the proceeds of a group term life insurance policy in the amount of $50,000 to be
             21      purchased by the division and paid for by the employing unit[.]; and
             22          (b) a group health insurance policy paid for by the employing unit that covers the
             23      employee's:
             24          (i) surviving spouse until remarriage; and
             25          (ii) unmarried children up to the age of 26.


             26          [(2)] (3) Any political subdivision [which employs a peace officer under Title 53, Chapter
             27      13, Peace Officer Classifications,] may provide the benefit under Subsection [(1)] (2).
             28          [(3) "Line of duty death" means a death resulting from external force or violence
             29      occasioned by an act of duty as a peace officer.]
