RESOLUTION ON TIME OF GENERAL

             6      A JOINT RESOLUTION OF THE LEGISLATURE PROPOSING TO AMEND THE UTAH
             7      CONSTITUTION; MODIFYING THE BEGINNING OF GENERAL SESSIONS; EXCLUDING
             8      A PRESIDENTS DAY OBSERVANCE IN CALCULATING 45-DAY LIMIT ON GENERAL
             9      SESSION; DIRECTING THE LIEUTENANT GOVERNOR TO SUBMIT THE PROPOSAL TO
             10      VOTERS; AND PROVIDING AN EFFECTIVE DATE.
             11      This resolution proposes to change the Utah Constitution as follows:
             12      AMENDS:
             13          ARTICLE VI, SECTION 2
             14          ARTICLE VI, SECTION 16
             15      Be it resolved by the Legislature of the state of Utah, two-thirds of all members elected to each of
             16      the two houses voting in favor thereof:
             17          Section 1. It is proposed to amend Utah Constitution Article VI, Section 2 , to read:
             18           Article VI, Section 2. [Time of general sessions.]
             19          Annual general sessions of the Legislature shall be held at the seat of government and shall
             20      begin on the [third] fourth Monday in January.
             21          Section 2. It is proposed to amend Utah Constitution Article VI, Section 16 , to read:
             22           Article VI, Section 16. [Duration of sessions.]
             23          (1) (a) No annual general session of the Legislature shall exceed 45 calendar days, except
             24      in cases of impeachment.
             25          (b) If the Legislature adjourns during an annual general session for a one-day observance
             26      of Presidents Day, that day may not be included in calculating the 45-day limit under Subsection
             27      (1)(a).


             28          (2) No special session shall exceed 30 calendar days, except in cases of impeachment.
             29          (3) When any session of the Legislature trying cases of impeachment exceeds the number
             30      of days it may remain in session as provided in this section, the members shall receive
             31      compensation only for expenses and mileage for those days in excess of 30.
             32          Section 3. Submittal to voters.
             33          The lieutenant governor is directed to submit this proposed amendment to the voters of the
             34      state at the next regular general election in the manner provided by law.
             35          Section 4. Effective date.
             36          If the amendment proposed by this joint resolution is approved by a majority of those
             37      voting on it at the next regular general election, the amendment shall take effect on January 1,
             38      2001.
