         USE OF TOBACCO SETTLEMENT REVENUES

Senator Beattie proposes the following amendments:

1.    Page 1, Line 11:    Delete "$4,000,000" and insert "$3,000,000" and after "TOBACCO" insert "AND SUBSTANCE ABUSE" and delete "$2,000,000" and insert "$3,000,000"

2.    Page 5, Line 122:    Delete "$4,000,000" and insert "$2,000,000" and delete "tobacco" and insert "alcohol, tobacco, and other drug"

3.    Page 5, Line 123:    Delete "a unified message" and insert "unified messages" and after "outlet" insert "with a preference in funding given to tobacco-related programs" and after line 123 insert:
        "(c) $1,000,000 to the Department of Health to be distributed to local health departments to continue tobacco prevention, reduction, cessation, and control programs;"

         Renumber the remaining subsections accordingly.

4.    Page 5, Line 124:    Delete "$300,000" and insert "$297,600" and delete "$1,700,000" and insert "$1,991,300"

5.    Page 5, Line 125:    After line 125 insert:
        "(e) $77,400 to the Board of Pardons, $108,700 to the Department of Corrections, and $525,000 to the Department of Human Service for a drug board pilot program;"

         Renumber the remaining subsections accordingly.

5.    Page 5, Line 129:    After line 129 insert:
        "(5)(a) If tobacco funds in dispute for attorneys fees are received by the state, those funds shall be divided and deposited in accordance with Subsection (3) and Section 63-97-301.
        (b) The amount appropriated to the Department of Health for alcohol, tobacco, and other drug programs described in Subsection (4)(b), including the funding preference for tobacco-related programs, shall be increased by up to $2,000,000 in a given fiscal

year to the extent that funds in dispute for attorneys fees are available to the state for appropriation from the account.

        (b) the amount appropriated to the Department of Health for alcohol, tobacco, and other drug programs described in Subsection (2)(b), including the funding preference for tobacco-related programs, shall be increased by up to $2,000,000 to the extent that funds in dispute for attorneys fees are available to the state for appropriation from the account created by Section 63-97-201.
