             6      This act amends the code regarding state officers and employees to provide that the director
             7      of state human resource management establish a plan for education compensation for law
             8      enforcement officers h and correctional officers h that addresses tuition and step
             8a      increases for specified higher education
             9      degrees.
             10      This act affects sections of Utah Code Annotated 1953 as follows:
             11      ENACTS:
             12          67-19-12.4, Utah Code Annotated 1953
             13      Be it enacted by the Legislature of the state of Utah:
             14          Section 1. Section 67-19-12.4 is enacted to read:
             15          67-19-12.4. Education benefit plan for law enforcement officers.
             16          (1) As used in this section, "law enforcement officer" has the same meaning as in Section
             17      53-13-103 h AND "CORRECTIONAL OFFICER" HAS THE SAME MEANING AS IN SECTION 53-13-104 h .
             18          (2) The director shall establish a plan authorizing any state agency to implement an
             19      educational compensation program for law enforcement officers h AND CORRECTIONAL OFFICERS h
             19a      employed by that state agency.
             20          (3) The program shall provide that in order for a law enforcement officer h OR
             20a      CORRECTIONAL OFFICER h to qualify for
             21      education benefits for college or university education, the law enforcement officer h OR
             21a      CORRECTIONAL OFFICER h shall:
             22          (a) provide a certified transcript of grades, demonstrating a grade point average of 3.0 or
             23      greater, from an accredited college or university; and
             24          (b) have successfully completed the probationary employment period with the employing
             25      agency.
             26          (4) The program shall also provide that h THE AGENCY MAY CONSIDER h a law


             26a      enforcement officer h OR CORRECTIONAL OFFICER h h [ may ] TO h receive additional
             27      compensation as follows for higher education degrees earned h ON OR AFTER APRIL 30, 2001, h in a
             27a      subject area directly related to


             28      the law enforcement officer's h OR CORRECTIONAL OFFICER' S h employment with the agency:
             29          (a) two steps for an associate's degree;
             30          (b) h [ four ] TWO h steps for a bachelor's degree; and
             31          (c) h [ six ] TWO h steps for a master's degree.
             31a           h (5) EXPENSES INCURRED BY AN AGENCY TO PROVIDE ADDITIONAL COMPENSATION
             31b      UNDER THIS SECTION MAY BE ONLY FROM THE AGENCY'S EXISTING BUDGET. h
