This act modifies the Code of Criminal Procedure regarding search warrants by providing
a specific definition of the term "daytime."
This act affects sections of Utah Code Annotated 1953 as follows:
AMENDS:
77-23-201, as renumbered and amended by Chapter 142, Laws of Utah 1994
Be it enacted by the Legislature of the state of Utah:
Section 1. Section 77-23-201 is amended to read:
77-23-201. "Search warrant" defined.

(1) "Daytime" means the hours beginning at 6 a.m. and ending at 10 p.m. local time.
(2) "Search warrant" is an order issued by a magistrate in the name of the state and directed
to a peace officer, describing with particularity the thing, place, or person to be searched and the
property or evidence to be seized by him and brought before the magistrate.
