             6      This act modifies the Motor Vehicle Code by amending certain off-highway vehicle
             7      registration provisions. This act takes effect on July 1, 2001.
             8      This act affects sections of Utah Code Annotated 1953 as follows:
             9      AMENDS:
             10          41-22-3, as last amended by Chapter 221, Laws of Utah 1993
             11      Be it enacted by the Legislature of the state of Utah:
             12          Section 1. Section 41-22-3 is amended to read:
             13           41-22-3. Registration of vehicles -- Application -- Issuance of stickers and card --
             14      Proof of property tax payment -- Records.
             15          (1) (a) Unless exempted under Section 41-22-9 , [no] a person may not operate or transport
             16      and [no] an owner may not give another person permission to operate or transport any off-highway
             17      vehicle on any public land, trail, street, or highway in this state unless the off-highway vehicle has
             18      been registered under this chapter for the current year.
             19          (b) Unless exempted under Section 41-22-9 , [no] a dealer may not sell an off-highway
             20      vehicle which can be used or transported on any public land, trail, street, or highway in this state,
             21      unless it has been registered or is in the process of being registered under this chapter for the
             22      current year.
             23          (2) The owner of any off-highway vehicle requiring registration under this chapter shall
             24      file an application for registration with the Motor Vehicle Division on forms approved by it.
             25          (3) Each application for registration of an off-highway vehicle shall be accompanied by:
             26          (a) evidence of ownership, a title, or a manufacturer's certificate of origin, and a bill of sale
             27      showing ownership, make, model, horsepower or displacement, and serial number;


             28          (b) the past certificate of registration; or
             29          (c) the fee for a duplicate.
             30          (4) [With every initial registration, the Motor Vehicle Division shall assign a number
             31      which shall remain with the vehicle and be valid until ownership of the vehicle is transferred. The
             32      number shall be displayed on the vehicle in a manner prescribed by the board. With every initial
             33      and subsequent] Upon each annual registration, the Motor Vehicle Division shall issue numbered
             34      stickers to be affixed to the vehicles as prescribed by the board and a registration card, which shall
             35      be available for inspection on the vehicle at all times.
             36          (5) The Motor Vehicle Division, before issuing a registration card and registration stickers,
             37      shall require from each applicant a certificate from the county assessor of the county in which the
             38      off-highway vehicle has situs for taxation. The certificate shall state one of the following:
             39          (a) the property tax on the off-highway vehicle for the current year has been paid;
             40          (b) in the county assessor's opinion, the tax is a lien on real property sufficient to secure
             41      the payment of the tax; or
             42          (c) the off-highway vehicle is exempt by law from payment of property tax for the current
             43      year.
             44          (6) (a) All records of the division made or kept pursuant to this section shall be classified
             45      by the Motor Vehicle Division in the same manner as motor vehicle records are classified under
             46      Section 41-1a-116 .
             47          (b) Division records are available for inspection in the same manner as motor vehicle
             48      records pursuant to Section 41-1a-116 .
             49          Section 2. Effective date.
             50          This act takes effect on July 1, 2001.
