APPROPRIATION FOR LAND USE PLANNING

             5      This act appropriates $500,000 from the General Fund for fiscal year 2001-02 to the Office
             6      of Planning and Budget for distribution to counties and other local governments for
             7      developing and implementing land use plans and to Southern Utah University to conduct
             8      workshops on land planning.
             9      This act enacts uncodified material.
             10      Be it enacted by the Legislature of the state of Utah:
             11          Section 1. Intent.
             12          The Legislature finds that appropriate land-use planning by the counties and other local
             13      governments is a matter of state concern and that the quality of land-use planning improves with
             14      training and education. It is the intent of the Legislature in appropriating these funds to help meet
             15      the statewide need for training and education of county, local, and state officials involved in
             16      land-use planning activities to improve the quality of land-use planning.
             17          Section 2. Appropriation.
             18          (1) (a) For fiscal year 2001-02 only, there is appropriated from the General Fund $500,000
             19      to the Office of Planning and Budget.
             20          (b) The Office of Planning and Budget shall:
             21          (i) distribute up to $10,000 of the appropriated funds to Southern Utah University for use
             22      by its Utah Center for Rural Life to conduct workshops on preparation of land-use plans, including
             23      protection of private property rights and other rights attached to property;
             24          (ii) determine, in conjunction with the Utah Association of Counties, the counties and
             25      other local governments most qualified to receive the remainder of the appropriated funds to assist
             26      in developing and implementing land-use plans, based on criteria established by the Governor's
             27      Local Government Comprehensive Planning Project Steering Committee;


             28          (iii) consider the recommendations of the Governor's Rural Partnership Board in
             29      determining the counties and other local governments most qualified to receive funds under
             30      Subsection (1)(b)(ii); and
             31          (iv) distribute the remaining funds to counties and other local governments that:
             32          (A) meet the criteria established by the Governor's Local Government Comprehensive
             33      Planning Project Steering Committee;
             34          (B) match the amount distributed by the Office of Planning and Budget in funds or in kind;
             35          (C) agree to encourage county, local, and state officials involved with land-use planning
             36      to attend the workshops; and
             37          (D) agree to review and, if necessary, revise the comprehensive general plan at least
             38      annually.
             39          (c) In planning and presenting the workshops provided under Subsection (1)(b)(i),
             40      Southern Utah University, through its Utah Center for Rural Life, may involve county and other
             41      local government officials who are preparing or have completed a land-use plan.
             42          (2) These appropriations are nonlapsing.
