6 This act modifies the Alcoholic Beverage Code and the Human Services Code to amend
7 provisions related to alcoholic beverage server training and to make technical changes. The
8 act clarifies who is required to be trained and the responsibilities of persons related to the
9 training.
10 This act affects sections of Utah Code Annotated 1953 as follows:
11 AMENDS:
12 32A-1-401, as last amended by Chapter 13, Laws of Utah 1998
13 62A-8-103.5, as last amended by Chapter 334, Laws of Utah 2000
14 Be it enacted by the Legislature of the state of Utah:
15 Section 1. Section 32A-1-401 is amended to read:
16 32A-1-401. Alcohol training and education -- Revocation or suspension of licenses.
17 (1) The commission may revoke, suspend, [
18 new or renewing licensee [
19 62A-8-103.5 , fail to complete the seminar [
20 (a) a person who manages operations at the premises of the licensee;
21 (b) a person who supervises the serving of alcoholic beverages to a customer for
22 consumption on the premises of the licensee; or
23 (c) a person who serves alcoholic beverages to a customer for consumption on the
24 premises of the licensee.
25 (2) A city, town, or county in which an establishment[

27 suspend, [

30 Section 2. Section 62A-8-103.5 is amended to read:
31 62A-8-103.5. Alcohol training and education seminar.

36 (1) As used in this section:
37 (a) "instructor" means a person that directly provides the instruction during an alcohol
38 training and education seminar for a seminar provider;
39 (b) "licensee" means a person who is:
40 (i) a new or renewing licensee under Title 32A, Alcoholic Beverage Control Act; and
41 (ii) engaged in the retail sale of alcoholic beverages for consumption on the premises of
42 the licensee; and
43 (c) "seminar provider" means a person other than the division who provides an alcohol
44 training and education seminar meeting the requirements of this section.
45 (2) (a) This section applies to a person who, as defined by the board by rule:
46 (i) manages operations at the premises of a licensee;
47 (ii) supervises the serving of alcoholic beverages to a customer for consumption on the
48 premises of a licensee; or
49 (iii) serves alcoholic beverages to a customer for consumption on the premises of a
50 licensee.
51 (b) A person described in Subsection (2)(a) shall:

54 (A) if the person is an employee, the day the person begins employment;
55 (B) if the person is an independent contractor, the day the person is first hired;
56 (C) if the person holds an ownership interest in the licensee, the day that person first
57 engages in an activity that would result in that person being required to complete an alcohol
58 training and education seminar; and
59 [
60 (A) to the seminar provider[
61 (B) that is equal to or greater than the amount established under Subsection (4)(h).
62 (c) Notwithstanding Subsection (2)(b)(i)(C), a person described in Subsection (2)(b)(i)(C)
63 shall complete an alcohol training and education seminar by no later than July 31, 2001, if as of
64 May 1, 2001 the person:
65 (i) holds an ownership interest in the licensee; and
66 (ii) has engaged in an activity that would result in that person being required to complete
67 an alcohol training and education seminar.
68 (3) (a) A licensee may not permit a person who is not in compliance with Subsection (2)
69 to:
70 (i) serve or supervise the serving of alcoholic beverages to a customer for consumption on
71 the premises of the licensee; or
72 (ii) engage in any activity that would constitute managing operations at the premises of a
73 licensee.
74 (b) A licensee that violates Subsection (3)(a), is subject to Section 32A-1-401 .
75 [
76 (a) (i) provide alcohol training and education seminars; or
77 (ii) certify one or more seminar providers;
78 (b) [
79 alcohol training and education seminar that includes the following subjects:
80 (i) (A) alcohol as a drug; and [
81 (B) alcohol's effect on the body and behavior;
82 (ii) recognizing the problem drinker;
83 (iii) an overview of state alcohol laws related to responsible beverage service, as
84 determined in consultation with the Department of Alcoholic Beverage Control;
85 (iv) dealing with the problem customer, including ways to terminate service; and
86 (v) alternative means of transportation to get the customer safely home; [
87 (c) recertify each seminar provider every three years;
88 (d) monitor compliance with the curriculum described in Subsection (4)(b);
89 (e) maintain for at least three years a record of every person who has completed an alcohol
90 training and education seminar;
91 (f) provide the information described in Subsection (4)(e) on request to:
92 (i) the Department of Alcoholic Beverage Control; or
93 (ii) law enforcement;
94 (g) provide the Department of Alcoholic Beverage Control on request a list of any seminar
95 provider certified by the division; and

99 (5) The board shall by rule made in accordance with Title 63, Chapter 46a, Utah
100 Administrative Rulemaking Act:
101 (a) define what constitutes under this section a person who:
102 (i) manages operations at the premises of a licensee;
103 (ii) supervises the serving of alcoholic beverages to a customer for consumption on the
104 premises of a licensee; or
105 (iii) serves alcoholic beverages to a customer for consumption on the premises of a
106 licensee;
107 (b) establish criteria for certifying and recertifying a seminar provider; and
108 (c) establish guidelines for the manner in which an instructor provides an alcohol
109 education and training seminar.

111 (a) obtain recertification by the division every three years;
112 (b) ensure that an instructor used by the seminar provider:
113 (i) follows the curriculum established under this section; and
114 (ii) conducts an alcohol training and education seminar in accordance with the guidelines
115 established by rule;
116 (c) ensure that any information provided by the seminar provider or instructor of a seminar
117 provider is consistent with:
118 (i) the curriculum established under this section; and
119 (ii) this section;
120 (d) provide the division with the names of all persons who complete an alcohol training
121 and education seminar provided by the seminar provider;
122 (e) collect a fee for each person attending an alcohol training and education seminar in
123 accordance with Subsection (2); and
124 (f) forward to the division the portion of the fee that is equal to the amount described in
125 Subsection (4)(h).
126 (7) (a) If after a hearing conducted in accordance with Title 63, Chapter 46b,
127 Administrative Procedures Act, the division finds that a seminar provider violates this section or
128 that an instructor of the seminar provider violates this section, the division may:
129 (i) suspend the certification of the seminar provider for a period not to exceed 90 days;
130 (ii) revoke the certification of the seminar provider;
131 (iii) require the seminar provider to take corrective action regarding an instructor; or
132 (iv) prohibit the seminar provider from using an instructor until such time that the seminar
133 provider establishes to the satisfaction of the division that the instructor is in compliance with
134 Subsection (6)(b).
135 (b) The division may certify a seminar provider whose certification is revoked:
136 (i) no sooner than 90 days from the date the certification is revoked; and
137 (ii) if the seminar provider establishes to the satisfaction of the division that the seminar
138 provider will comply with this section.
