6 This act modifies provisions related to school and institutional trust lands by requiring the
7 School and Institutional Trust Lands Administration and Department of Natural Resources
8 to enter into a memorandum of agreement allowing the Department of Natural Resources
9 to consult and collaborate with the School and Institutional Trust Lands Administration on
10 strategies to protect critical wildlife habitat and the management or development of trust
11 lands within or adjacent to state parks.
12 This act affects sections of Utah Code Annotated 1953 as follows:
14 53C-2-203, Utah Code Annotated 1953
15 Be it enacted by the Legislature of the state of Utah:
16 Section 1. Section 53C-2-203 is enacted to read:
17 53C-2-203. Memorandum of agreement with Department of Natural Resources --
19 (1) By October 1, 2001, the director of the School and Institutional Trust Lands
20 Administration and the executive director of the Department of Natural Resources shall enter into
21 a memorandum of agreement to allow the Department of Natural Resources to consult and
22 collaborate with the administration on:
23 (a) strategies to protect critical wildlife habitat on trust lands and trust lands designated
24 for disposal; and
25 (b) the management or development of trust lands located within or adjacent to state parks.
26 (2) The objectives of the memorandum of agreement are to:
27 (a) provide an early opportunity for the Department of Natural Resources to confer with
28 the administration on land management decisions affecting critical wildlife habitat or state parks;
29 (b) promote mutual understanding of the needs and goals of the various trust lands
30 interests, including the beneficiaries, prospective trust lands users, and the general public; and
31 (c) allow for sufficient time to develop land use plans and strategies that:
32 (i) are consistent with the interests of the trust beneficiaries;
33 (ii) minimize impacts to critical wildlife habitat; and
34 (iii) enhance the public's use and enjoyment of state parks.
