             5      This act modifies the Wildlife Code to prohibit a person born after December 31, 1965, from
             6      purchasing a hunting license or permit unless the person provides proof of passing a hunter
             7      education course.
             8      This act affects sections of Utah Code Annotated 1953 as follows:
             9      AMENDS:
             10          23-19-11, as last amended by Chapter 86, Laws of Utah 2000
             11      Be it enacted by the Legislature of the state of Utah:
             12          Section 1. Section 23-19-11 is amended to read:
             13           23-19-11. Age restriction -- Proof of hunter education required.
             14          (1) [The division may not issue a hunting license or permit to any] A person born after
             15      December 31, 1965, may not purchase a hunting license or permit unless proof is presented to the
             16      division or one of its authorized wildlife license agents that the person has passed a [division
             17      approved] division-approved hunter education course offered by a state, province, or country.
             18          (2) For purposes of this section, "proof" means:
             19          (a) a certificate of completion of a hunter education course;
             20          (b) a preceding year's hunting license or permit issued by a state, province, or country with
             21      the applicant's hunter education number noted on the hunting license or permit; or
             22          (c) verification of completion of a hunter education course pursuant to Subsections (3) and
             23      (4).
             24          (3) If an applicant for a nonresident hunting license or permit is not able to present a
             25      hunting license, permit, or a certificate of completion as provided in Subsections (1) and (2), the
             26      division may contact another state, province, or country to verify the completion of a hunter
             27      education course so that a nonresident hunting license or permit may be issued.


             28          (4) If an applicant for a resident or nonresident hunting license or permit has completed
             29      a hunter education course in Utah but is not able to present a hunting license, permit, or a
             30      certificate of completion as provided in Subsections (1) and (2), the division may research the
             31      division's hunter education records to verify that the applicant has completed the hunter education
             32      course.
             33          (5) (a) If an applicant for a resident or nonresident hunting license has completed a hunter
             34      education course and is applying for a hunting permit or license through the division's drawings,
             35      Internet site, or other electronic means authorized by the division, the applicant's hunter education
             36      number and the name of the state, province, or country that issued the number may constitute proof
             37      of completion of a hunter education course under this section.
             38          (b) The division may research the hunter education number to verify that the applicant has
             39      completed a division-approved hunter education course.
             40          (6) Upon issuance of the hunting license or permit, the division shall indicate the
             41      applicant's hunter education number on the face of the hunting license or permit.
             42          (7) The division may charge a fee for any service provided in Subsection (3) or (4).
