First Substitute H.B. 273

Representative Kevin S. Garn proposes to substitute the following bill:

             6      This act modifies provisions relating to the State System of Public Education by creating the
             7      Growth in Student Population Restricted Account within the Uniform School Fund. The act
             8      allows monies from the account to be used by school districts to address the anticipated surge
             9      in student growth. The act appropriates up to $20,000,000 to the account and has an
             10      effective date of July 1, 2001.
             11      This act affects sections of Utah Code Annotated 1953 as follows:
             12      ENACTS:
             13          53A-16-112, Utah Code Annotated 1953
             14      Be it enacted by the Legislature of the state of Utah:
             15          Section 1. Section 53A-16-112 is enacted to read:
             16          53A-16-112. Growth in Student Population Restricted Account.
             17          (1) There is created within the Uniform School Fund a restricted account known as the
             18      "Growth in Student Population Restricted Account."
             19          (2) The account shall be funded from the following revenue sources:
             20          (a) any voluntary contributions received to help alleviate the anticipated surge in student
             21      growth in public elementary and secondary schools during the early part of the 21st Century; and
             22          (b) appropriations made to the fund by the Legislature.
             23          (3) The account shall be used to help school districts meet the challenges created by
             24      anticipated significant increases in student growth in the state's public schools.
             25          (4) (a) The account shall earn interest.


             26          (b) All interest earned on account monies shall be deposited in the account.
             27          Section 2. Intent language.
             28          (1) It is the intent of the Legislature that after allocating all contingent appropriations or
             29      designations required by statute for fiscal year 2001-02, all unrestricted, undesignated, and
             30      unencumbered surplus remaining in the Uniform School Fund up to $20,000,000 is appropriated
             31      to the Growth in Student Population Restricted Account created in Section 53A-16-112 to be used
             32      for the purpose listed in Subsection 53A-16-112 (3).
             33          (2) The appropriation is nonlapsing.
             34          Section 3. Effective date.
             35          This act takes effect on July 1, 2001.
